We respond to requests under the Freedom of Information Act 2000 and
Environmental Information Regulations 2004.
I enclose your data.
Notes for the first spreadsheet – Prosecutions and Formal Cautions:
The data provided in the report on prosecutions and formal cautions is the
combined output of two enforcement recording systems: the National
Enforcement Database (NED) and the Case Management System (CMS). Because
of differences in the source systems, the information provided is not
always exactly the same for each record. This has resulted in, for
instance, some records with certain fields left blank.
Notes for the second spreadsheet – Warning Letters & Notices:
The data for Warning Letters and Notices issued to companies is taken from
CMS. This goes back to late 2012 as this is when CMS went live.
We do not hold details of the company number so we were unable to provide
this. Some of the fields for industry sector and date the notice was
served are blank therefore we are unable to provide these details as they
were not completed on the CMS record.
Notes for the third spreadsheet – Civil Sanctions:
Please find provided a spreadsheet containing details of cases involving
companies where the final outcome of the investigation was a civil
sanction under the provisions of the Regulatory Enforcement and Sanctions
Act 2008.
Please note that based on your criteria the information provided relates
to Enforcement Undertakings (EUs) and Fixed Monetary Penalties (FMPs)
only.
Please note that we are unable to provide company number, as this is not
recorded on our national civil sanctions casetracker and sector details
have been included where that information has been recorded.
I have attached our conditional licence at the link below which explains
the permitted use of this information.
