all failed levies where goods have to be returned

this does not relate to your councils behaviur and no complaint will be made fyi but for general research into the contracts local authourities

Thank you for your request for information about enforcement agents duty
to disclose.  Your request was received by the Information Rights Team on
22 February 2021.  This is being dealt with under the terms of the
appropriate Information Rights legislation.

Response: All of our Enforcement Agents follow a strict authorisation
process, whereby they are required to gain relevant authorisation prior to
seizing goods. This involves gaining appropriate authorisation from both
their senior enforcement management team and the local authority.
Authorisation would be given, where after review of the specific
circumstances and the goods to be seized, it is deemed appropriate to
seize the goods.

any settlement agreements made that the council is not included on or has

Response: Our enforcement agents would not be able to make their own
settlement agreements. All agents strictly follow instructions from their
company and the authority. All agents wear body worn video (BWV) and
regular auditing is completed internally for training and monitoring
purposes. Enforcement Agents act entirely within the Taking Control Of
Goods (TCOG) regulations.

any settlement agreements they have made with vulnerable people

Response: All Enforcement Agents act within the TCOG regulations and
ensure that where vulnerability is identified, they act appropriately. Our
Enforcement Agents would assess each case individually and retreat from
the property where appropriate. All agents will clearly note any concerns
relating to any vulnerability and this is regularly reported back to the
Authority so that the most appropriate steps can be taken. The Enforcement
Agents have a specialist welfare team which manage any vulnerable cases
accordingly.
