under foi can you please answer the following for our research purposes only.their is no claim coming
do your enforcement agents under your contract have
a duty to disclose
failed levies where goods have to be returned
settlement agreements after goods have had to be returned
settlement agreements with vulnerable people in hospital where goods have to be returned
If your answers are no given thesethen would be classified as fraud .would you classify these as a material breach ?
would you terminate the contract of any enforcement agent who fails to disclose settlement agreements that may cause the public legal action at a later date ?

to Enforcement Agent’s duty to disclose
From our preliminary assessment, it is clear that we will not be able to
answer your request without further clarification.
The Council requires further information in order to identify and locate
the information you have asked for. In particular, it would be useful to
know
· What do you mean by “duty to disclose” – does this mean the Agent
has a duty to inform the Council or to make the information public?
· The final two questions appear to seek an opinion from the
Council. The Freedom of Information Act 2000 only requires the Council to
provide information that it holds. You may wish to reword these requests
so they are requests for information likely to be held by the Council.
Once you have clarified your request, I will be able to process your
request. If I do not receive clarification within three months your
request will be considered to have lapsed. (a public authority need not
comply with a request unless sufficient information, reasonably required
to locate the information, is supplied).
