I am writing in response to your request for information under the terms
of the Freedom of Information Act 2000, Ref No FOI/18/073.

Please find below, the details of your request and our response in blue.

 

 

Requested:

 

Under the Freedom of Information Act, please can you provide me with a
list of long-term empty houses  12 months or more  within

your council area, with their  addresses please

 

Under Section 1 (1) of the Freedom of Information Act 2000, Chorley
Council has a duty to confirm or deny that it holds the information
requested.  I can confirm that Chorley Council does hold information
regarding empty properties. 

 

However, Section 31(1)(a) of the Freedom of Information Act 2000 states
that ‘Information which is not exempt information by virtue of Section 30
is exempt information if its disclosure under this Act would, or would be
likely to, prejudice –

(a)   the prevention or detection of crime’

 

We believe that disclosure of this information creates a real and
significant threat, in that there is increased potential that these
buildings could be targeted by squatters, criminals, terrorists, or
vandals.

 

Section 31 is a qualified exemption and we are therefore obliged to
consider the public interest test.

 

In line with the terms of this exemption, we have considered whether or
not it would be in the public interest for us to release this information,
despite the exemption being applicable.  In this case, we have concluded
that the public interest test favours withholding this information.

 

I therefore refuse your request for this information, under Section 31 of
the Freedom of Information Act 2000.

 

 

I hope the information provided here answers your enquiry.  If however,
you are unhappy with the outcome, or the way in which Chorley Council has
handled your request, you may wish to make an appeal.  This can be done in
writing to the Information Manager, Chorley Council, Civic Offices, Union
