Empty Property List

confirm that we do not appear to have received your request. I check
this daily, and we will always acknowledge any requests received within

Mr Boyd,

Thank you for your email. As you can see I have received the request
now. I'm not sure why the other email was not received by us. I know
that our IT department look through the FOI inbox to check if any emails
have been caught in the spam guard when they should not have done.

Having read your request, I wondered if you could clarify one thing. You
talk of "empty property". Are you after residential or commercial
properties? Or both? Once I receive clarification of your request, then
I shall pass your request to the relevant department.

Freedom of Information Act 2000 - Information Request

Thank you for your request for information on empty commercial and
residential properties. This was dated and received on 14 April 2010. The
request has now been considered and some of the information requested is
attached.

The first attachment shows the commercial properties registered on our
NNDR database as empty. The second attachment lists the residential
properties registered on our council tax database registered as long-term
empty (ie more than six months) and where the liability owner is recorded
as a business, housing association or other body.

We have redacted the addresses of empty properties where the liability is
with an individual, under Section 40 of the Freedom of Information Act,
Personal Information. We consider the information, where it relates to an
individual is the personal information of that person. Therefore, we feel
that to disclose this information publicly as a result of a request made
under the Freedom of Information Act could breach our obligations to
protect the privacy of individuals as designated by the Data Protection
Act. We suggest that the individuals concerned would not expect this
information to be disclosed publicly, and after consideration we cannot
satisfy any of the conditions for processing held in Schedule Two of the
Act. As a result Section 40 of the FOIA is engaged. This judgement
reflects the ruling by the Information Tribunal re, England v London
Borough of Bexley (EA/2006/0060 & 0066).

I hope this satisfies your enquiry, however if you are dissatisfied with
the information provided please contact the Information and Records
Officer within two months of receipt of this letter at Allerdale Borough
Council, Allerdale House, Workington CA14 3YJ, phone (01900) 702701, email

decision.
