Could you please provide a list of "Empty Residential and
commercial properties" in the Shepway area detailing their
address and post code. Please also add a note beside each property when that property first became empty.

Dear Peter Lindley,

I am writing in respect of your Freedom of Information enquiry dated 4
November 2013. This request has been handled under the Freedom of
Information Act 2000.

Please find below information in response to your request.

1. List of empty commercial properties in the Shepway area.
Please see attached spreadsheet.

2. List of empty residential properties in the Shepway area.
I can confirm that the council holds the information that you have
requested, however we consider that exemptions apply and have to refuse
your request. Under the Freedom of Information Act we have the right to
refuse an applicant information held if an exemption applies.

The exemption applied is Section 31(1)(a): Complying with the request
would, or would be likely to, prejudice the prevention of crime. Whilst
we recognise that there may be a public interest in this information in
this case we consider that the public interest in maintaining the
exemption outweighs the public interest in disclosing the information
(Section 2(2)(b)).

Also in the case of Yiannis Voyias v Information Commissioner and the
London Borough of Camden (EA/2011/0007 22 January 2013) the First Tier
Tribunal upheld the London Borough of Camden's decision to withhold
addresses of empty houses under Section 31(1)(a).
