Freedom of Information Act request - 2012/6703 - Empty Properties

 

Dear Mr Kertesz,

 

I refer to your request for information received on 05/10/2012.  Please
see the information below in response to your request: -

 

Please could you provide me with the most recent list of properties that
have applied for empty rates relief due to vacancy

 

Your request for information has been considered.  I can confirm that
Wandsworth Council holds the requested information.  However, the Council
considers information on the addresses of empty properties to be exempt
from disclosure under the Act:

 

Section 31(1)(a) – Law Enforcement – Prevention and detection of crime

 

Information is exempt from disclosure where this would be likely to
prejudice the prevention and detection of crime.  This does not require
the Council to establish the probability of the occurrence of this
prejudice is more likely than not, only that there is a real and
significant risk of the harm occurring. It is the Council's opinion that
disclosure of this information would be likely to prejudice the prevention
and detection of crime.  As a consequence, this information is considered
to be exempt.

 

The Council has additionally sought the opinion of the Borough Commander,
who was of the opinion that the disclosure of this information would be
likely to prejudice the prevention and detection of crime.  The Council
finds it difficult to ignore the opinion of an experienced Officer.

 

This exemption requires the Council to consider the public interest
exemption when considering whether to disclose the requested information. 
Whilst the Council recognises there is a public interest in enabling
properties to be brought back into use and a general interest in
transparency, we are also bound to consider the strong public interest in
reducing the potential for criminal activity.  

 

It is the Council’s opinion that the public interest favours maintaining
this exemption and withholding the requested information.

 

Additionally, where these properties are residential properties the
Council would consider this to be exempt by virtue of being the personal
data of the homeowners, the disclosure of which would be unfair.

 

Section 40(2) – Personal Data

 

Information is exempt from disclosure where this would represent a breach
of one or more principles of the Data Protection Act. 

 

Information relating to the addresses of empty residential properties
constitutes personal data of the owners of these properties, the
disclosure of which would be unfair and represent a breach of the
principles of the Data Protection Act.  As a consequence, this information
is considered to be exempt.
