FREEDOM OF INFORMATION ACT 2000 – INFORMATION REQUEST FOI-2122-407

 

Your request for information has now been considered and the Council has
decided to withhold the information you have requested. In accordance with
the Freedom of Information Act 2000 this letter acts as a Refusal Notice.

 

(a) addresses of all a list of empty residential properties that are
within the Council area?

 

 

The Exemption Applied: Section 31 Law enforcement.  (1) Information which
is not exempt information by virtue of section 30 is exempt information if
its disclosure under this Act would, or would be likely to, prejudice— (a)
the prevention or detection of crime,

We can confirm that we do hold this information, however we do not provide
a list of Council Tax accounts of empty properties as this information may
prejudice the prevention or detection of crime, in particular, criminal
damage or illegal entry.  The exemption under Section 31(1)(a) FOI
applies.

Pursuant to section 31(1)(a) of the Freedom of Information Act 2000 (FOI
Act), public authorities are not obliged to release information that would
be likely to prejudice the functions of law enforcement- namely the
prevention and detection of crime.  

 

In making this decision we  have taken into account the LB Hammersmith &
Fulham (FS 0643256) 04/10/2017 – NNDR credit balances see decision below.
 

“The complainant has requested information relating to credit balances in
respect of all ratepayers within the billing area of London Borough
of Hammersmith & Fulham (“the Council”).  The Council refused to disclose
the requested information, citing section 31(1)(a) of the FOIA as a basis
for non-disclosure.  The Commissioner’s decision is that the Council has
correctly applied section 31(1)(a) of the FOIA to the requested
information. “

 

(b) the names of the owners of those properties referred to in (a)

 

(c) the registered address of the owners referred to in (b)

 

For properties owned by individuals we can confirm that we do hold the
information but there is a wider exemption that applies to the request as
the information is considered to be personal I data and exempt under
Section 40 (2) FOI. Please see details of the exemption below:

 

The FOIA Exemption applied is:

Section 40(2) Personal information.

(1)Any information to which a request for information relates is exempt
information if it constitutes personal data of which the applicant is the
data subject.

(2)Any information to which a request for information relates is also
exempt information if—

(a)it constitutes personal data which [[1]F1does] not fall within
subsection (1), and

(b)[[2]F2the first, second or third] condition below is satisfied.

You have the right to request an internal review in respect of this
decision. Internal review requests should be made within 40 working days
of the initial response. If you wish to request an internal review  please
