1. How many do we have at our council since 2012

2. What jobs do they do

I wish to confirm that North East Lincolnshire Council holds the following
information:

 

I am interesting in understanding the roles of Independat person 

 

1.    How many do we have at our council since 2012

 

We have one Independent Person and one Deputy.  The same individuals have
fulfilled these posts since 2012.

 

2.  What jobs do they do

             

Review material relating to relevant complaints against a Member of the
Authority and to give formal views, which must be taken into account,
before a decision can be taken on a complaint it has decided to
investigate;

Give views, if requested by the Monitoring Officer, on any other
allegation that has been received; and

Give views, if requested by any member, or co-opted member, of the
authority, if that person’s behaviour is the subject of an allegation.

 

3.    How are they paid  ( examples please )

 

No salary is paid but travel and subsistence expenses are paid.

The Independent Person does not investigate complaints but is able to give
a view.

 

What protections are in place to avoid conflict of interest

 

The Independent Person is not involved in any investigation, he merely
gives a view as to conduct issues. Prior to being invited to give a view
on an allegation, the Independent Person is given the opportunity to
declare any potential conflict of interest.  If this is the case then the
matter would be referred to the Deputy Independent Person.

 

If you believe that your request for information has not been handled in
accordance with the Freedom of Information Act, you have the right to
request an internal review by the Council. Please be clear about which
elements of the Council’s response or handling of the request you are
unhappy with, and would like the Council to address during the internal
review process.  If following this you are still dissatisfied you may
contact the Office of the Information Commissioner. If you wish to request

arrangements.

Further to your request an Internal Review has taken place into North East
Lincolnshire Council's handling of your information
request NELC/6651/1718, concerning the role of the independent person.

I have reviewed the response provided to you and the handling of your
request in accordance with the Freedom of Information Act and find:

o That your request was responded to within the statutory time of 20
working days;
o That you were informed whether or not the information you asked for
was held by North East Lincolnshire Council;
o That you were provided with the information you asked for available
under the Freedom of Information Act; and
o That your response provided you with your rights of appeal. 

I am therefore satisfied that the Council has acted in accordance with the
Freedom of Information Act in the handling of your request.

You state that part of the response was not provided to you. Please see
below an extract from the original request and response:

Response: “The Independent Person does not investigate complaints but is

To clarify, North East Lincolnshire Council holds no information regarding
this element of your request as the independent person does not
investigate complaints.

I note you have revised your question to now ask for investigations that
the independent person has given their opinion on. This was not originally
asked for as part of the request and therefore would be a new request and
I would appreciate if you can confirm this is the case.

I trust that this Internal Review answers your queries in relation to your
request, and clarifies that your request has been handled in accordance

My question

that is not an answer to the question i asked, its an answert to a totaly different question that I DIDNT ask.

you then go on to say

Dpoes that meen there is no paperworek in relation to thsi person and there activitys. I doubt it, but thats wht your trying to imply

It si the case, but i consiuder it part of the origional request as i was further exporing your answer.
