Dear Gonville and Caius College, Cambridge,

I am writing to make a request under the Freedom of Information Act 2000 for information relating to your employment practices. I would like to know the following:

1. As of July 14th 2019, the longest length of time workers (employees or casual workers) in the college in non-academic/administrative positions who are over the age of 18 and paid below £9 per hour have been employed by the College, registered on the College’s payroll,

2. As of July 14th 2019, the median length of time workers (employees or casual workers) in the college in non-academic/administrative positions who are over the age of 18 and paid below £9 per hour have been employed by the College, registered at the College.

3. How many workers (employees or casual workers) in year preceding July 14th 2019, who are over the age of 18 in non-academic or administrative positions that are not guaranteed over 16 hours a week in their contract.

4. How many workers (employees or casual workers) in the year preceding July 14th 2019, who are over the age of 18 in non-academic positions that are not guaranteed above 0 hours of work per week in their contract.

If you are to invoke Section 43 to withhold information in relation to any of these questions please note you must provide details of the exact FOIA exemption, details of who would be prejudiced by this information, and a public interest test justifying a conclusion with arguments for and against the release of the information.

I am writing to acknowledge your Freedom of Information requested dated 18 July 2019. The answers to your questions are as follows, between asterisks:

1. 4. How many workers (employees or casual workers) in the year preceding July 14th 2019, who are over the age of 18 in non-academic positions that are not guaranteed above 0 hours of work per week in their contract. *50*

If you are unhappy with the service you have received in relation to your request and wish to make a complaint or request a review of this decision, you should write to the Senior Bursar, Gonville & Caius College, Trinity Street, Cambridge, CB2 1TA 0DF who will then assign an appropriate person to conduct the internal review. If subsequently you are not content with the outcome of your complaint, you may apply directly to the Information Commissioner for a decision. Generally, the Information Commissioner cannot make a decision unless you have exhausted the complaints procedure provided by the College. Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Gonville and Caius College, Cambridge's handling of my FOI request 'Employment Conditions 2019'.

The majority of colleges who I have sent this request to have complied with providing the information required under all 4 questions without using Section 40(2) as a potential hurdle to providing this data. As other bodies have not deemed this information to be against their commerical interests I would like to request that this is reviewed by the college prior to sending this issue to the Information Commissioner.

Dear Ms Newbold,
I am writing with my response to your request for an internal review of
the FOI request for "Employment Conditions 2019" dated 16th August.
I have read your original questions and the response by our FOI officer,
the Senior Bursar, dated 9th August.
I have reviewed the available information and the applicable legislation,
including the Freedom of Information Act 2000 and the Data Protection Act
2018.
I conclude that the reply to your first question was correct: The
information [you request] is exempt under section 40(2) Freedom of
Information Act 2000. In the context of this college as an employer,
positively answering that question would not protect against the
identification of individuals in breach of data protection principles. I
applied the "motivated intruder" test.
Please note that the college did not claim exemption for "commercial
interest" which would fall under s 43 not s 40(2).
