Dear Sir or Madam,

I was hoping you would be able to help me with a FOI request.
Employment and Support Allowance was introduced in October 2008.
Please would you be able to give details of:

The number of Upper Tier Tribunal decisions (formerly Commissioners
decisions) there have been on Employment and Support Allowance
since its introduction.

Also please could you provide the reference numbers for each
decision made at the Upper Tier Tribunal and a Statement of reasons
for each decision.

Yours faithfully,

Richard Gordon

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of The Tribunals
Service's handling of my FOI request 'Employment and Support
Allowance Upper Tier Tribunal decisions'.

The response stated that the reference numbers of upper tier
tribunal decisions wouldnt be allowed to be provided as they would
be covered under the data protection act. The upper tier tribunal
decisions are published and are available on the tribunal service
website and other internet resources such as baili.org. Please
would you be able to investigate whether in fact they are covered
by data protection laws or otherwise as the results of upper tier
tribunals are published as publicly available documents. One
example of a published decision is:

CSDLA/136/2009

A full history of my FOI request and all correspondence is
available on the Internet at this address:

Yours faithfully,

Richard Gordon
