I am requesting the same information from you. This is for the period 1 april 2010 to 31 March 2014.

1) In Flintshire there are a number of incinerators burning waste material. Given the potential health risks, what checks have been undertaken to ensure the emissions from these are within safe limits?

2) What monitoring takes place in relation to the emission of small particles?

3)What were the findings of monitoring done by National Resources Wales to date?

I am writing to request an internal review of Natural Resources Body for Wales's handling of my FOI request 'Emissions from incinerators in Flintshire'.

The response does not provide the information requested under the provisions of The Freedom of Information Act.

It is unacceptable to say that records held in Buckley can be viewed to obtain the information. This response is unlawful under the terms of the FOI Act.

There has been a failure to answer the FOI request. Am I, or are people, expected to travel, maybe hundreds of miles, to visit and inspect records in Buckley?

Please provide the information requested lawfully via this site.

Further to your email dated 4th July. For clarification the information you request is environmental information therefore it is considered under the Environmental Information Regulations. For clarification should we have considered your request under the Freedom of Information act then the information you request would be excluded under Section 21 information available via another source. We have contacted the ICO and confirmed that the information is environmental, however this information is freely available via the public register ie another source and therefore is not considered under either the EIR or FOI.

The original FOI request asked for the following information:

1)In Flintshire there are a number of incinerators burning waste material. Given the potential health risks, what checks have been undertaken to ensure the emissions from these are within safe limits?

Please note that in the previous response, your colleague again advised that this information is available from other sources. This relies on someone, myself or another, visiting the premises in Buckley. Since I live many miles away I would argue that this is not a defence to refusing to supply this information. It is unreasonable to suggest that the FOI request will not be met on this basis.

1)      In Flintshire there are a number of incinerators burning waste
material. Given the potential health risks, what checks have been
undertaken to ensure the emissions from these are within safe limits?
Currently, there are 2 incinerators in Flintshire burning waste material.
These are UPM-Kymmene Shotton Paper Mill and Castle Cement Padeswood.
Different types of waste material are burnt at each of these sites. Both
sites are subject to the Environmental Permitting Regulations and
therefore have an environmental permit issued by Natural Resources Wales.
These permits detail how the site must be operated and impose strict
emission limit values and monitoring and reporting requirements. We have a
dedicated team, the Pollution Prevention and Control Team based in our
Buckley office, who regulate these sites. The environmental permits and

all associated monitoring and reporting data are Public Register documents
and can be viewed at our Buckley office.

2)       What monitoring takes place in relation to the emission of small
particles? This is detailed in the environmental permits. Both sites are
fitted with Continuous Emission Monitors (CEMs) which continually measure
and record the stack emissions. These emissions must meet strict emission
limit values. Periodically the stack emissions are also monitored by
accredited companies to ensure the CEMs equipment is accurate.
