As stated in my reply to you on the 26 September 2016 we are within our rights to withhold/redact information that would fall within Section 38 Health and Safety. As already stated we have withheld personal information relating to staff contact details and that of the exact process we would follow in an emergency. We will not expose any of our staff or students to any possible harm by openly sharing our detailed plans.

We will not be responding to any further requests for detailed information relating to Emergency responses to threats to our campus in any guise. These will be treated as malicious requests and will be forwarded to the relevant organisation

Under section 38 Health and safety.

(1)Information is exempt information if its disclosure under this Act would, or would be likely to— (b)endanger the safety of any individual.

We are a college with the responsibility of 7500 students and our duty of care and safeguarding responsibilities are such that we believe that sharing the detail of our Emergency Procedures would impact on the safety of our students and staff. Under the qualified exemption we are able to disclose the general elements of our policy and procedures for such an incident however we are not required to share this in detail.

As part of our Public Interest Test we also considered whether this request was 'class-based' or 'prejudice-based'. It was our conclusion that this was to be assessed under the 'prejudice-based' exemption. Prejudice-based exemptions protect information where its disclosure would or could be likely to harm a particular interest (for example the prevention or detection of crime). In this instance we believe that the disclosure would harm the prevention of crime, if the details of our policy and procedures were released then this could inform a potential attacker of what to expect and plan accordingly.

Further clarity has also been sought from the Information Commissioners Office regarding this request. If you feel that we have not met with your request in a satisfactory manner then please refer to the web link below giving the contact details of the ICO where you can appeal against our judgement.
