Emergency LOS and Bed Modelling

We're waiting for wali aslam to read a recent response and update the status.

Dear Worcestershire Acute Hospitals NHS Trust,

I had a look at the September 2018 Board report F3 Winter Plan and was interested in what information is available to see h the 2018/19 predictive model was put together, particularly the following parts.
Baseline Forecast Average and
Forecast Average with Scenarios
particulary how % above 100% were calculated. Please include any spreadsheet that might be useful.

In the integrated performance report, there is a line showing the emergency monthly average length of stay, disregarding zero length of stay. I would like to request this monthly average figure from April 2013 onwards and also the total cases these refer to.
Do the emergencies cover surgical and medical and maternity areas?

Response - We are undertaking a public interest test with respect to the
answer to this question. We are looking to use an exemption undfer Section
43(1) of the Freedom of Information Act 2000. We will write to you within
a further 20 days to let you know the outcome of the public interest test.

would include surgical, medical and excludes maternity.  Due to a change
in our data warehouse – reliable data is available from April 2015.

We have undertaken our public interest test and are applying to your first
question an exemption under Section 43 (1) of the Freedom of Information
act 2000 on the grounds that the information requested constitutes a trade
secret. This is on the basis that the information requested is a series of
complex calculations and formulas which has been invented by the Trust. It
has not been widely disseminated and is not widely known. It could not be
easily recreated and is technical, unique and achieved with a degree of
difficulty and investment. Commercial opportunities are currently being
explored. Copyright is being sought.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Worcestershire Acute Hospitals NHS Trust's handling of my FOI request 'Emergency LOS and Bed Modelling'.

Thank you for your reply on the 14th December 2018 to my FOI request dated the 27th September 2018, a period of 78 days, well in excess of the 20 working days indicated by the FOIA.

The 14th December reply only addressed part 1 of the request, not Part 2, which is shown below:

"In the integrated performance report, there is a line showing the emergency monthly average length of stay, disregarding zero length of stay. I would like to request this monthly average figure from April 2013 onwards and also the total cases these refer to.
Do the emergencies cover surgical and medical and maternity areas?"

In the absence of a reply, I am appealing for an answer to these Part 2 questions.

For Part 1, the Trust has applied an "exemption under Section 43 (1) of the Freedom of Information
act 2000 on the grounds that the information requested constitutes a trade secret."

The relevant ICO guidance on the public interest test states:

"The authority must consider the balance of public interest in the
circumstances of the request.
There will always be a general public interest in transparency. There
may also be a public interest in transparency about the issue the
information relates to.

The authority should consider any public
interests that would be served by disclosing the information.
If there is a plausible suspicion of wrongdoing on the part of the
public authority, this may create a public interest in disclosure. And
even where this is not the case, there is a public interest in
releasing information to provide a full picture."

I am appealing against this decision on the following grounds:

1) The Trust has only listed reasons for applying this exemption and has not weighed the public interest against these reasons, as required under this exemption.

2) There is a general public interest in transparency.

3) There is a public interest about the issue of the modeled bed occupancy for future months, and the possible health consequences for the Worcestershire population.
The September 2018 enclosure F3 Winter Plan which contained the predictive model on page 25, was part of the publicly available board reports.

4) The issue of how many additional beds are needed for the winter and possible additional funding at Worcester Acute Hospitals was described in the 14th December edition of the HSJ magazine.
This clearly indicates a public interest in promoting discussion and understanding of this issue for Worcester Acute Hospitals and other acute Hospitals which will be facing similar issues.

5) Access to the detailed calculations of likely bed occupancy would enable public scrutiny of the reasonability of the assumptions behind the modelling. The only way to enable scrutiny is to enable access to the modelling assumptions.

6) It is unlikely that what appears to be spreadsheet calculations constitute a trade secret.
Trusts around the country will be doing very similar calculations.

7) There is no evidence that the Trust has a commercial arm which provides income based on management consultancy activity or has engaged in competitive tenders for management consultancy work.

8) It did not appear that commercial activities were being pursued in this area or that copyright was being pursued before the receipt of my FOI request.

Overall, the public interest appears to overwhelmingly support disclosure of the Part 1 information in my 27/9/2018 FOI request.
