Dear Sir/Madam,

Thank you for your email of 15th March about emergency lighting at London
Underground (LU) stations.

Please see the information below in response to your queries which has
been provided by our Team with responsibility for London Underground:-

 

1. Is London Underground required to have emergency lighting at their
stations under HMRI regulations?

There are no railway-specific health and safety regulations requiring
emergency lighting at railway stations.

The Regulatory Reform (Fire Safety) Order 2005 (enforced by the local fire
and rescue authority) states at s.14(h): “emergency routes and exits
requiring illumination must be provided with emergency lighting of
adequate intensity in the case of failure of their normal lighting.”

In the case of London the enforcing authority is the London Fire Brigade
(LFB). There may be further requirements regarding emergency lighting in
other fire safety legislation but LFB would need to be contacted about
this as ORR does not enforce this legislation.

 

For its own staff, LU must provide emergency lighting in accordance with
The Workplace (Health, Safety and Welfare) Regulations 1992.

Regulation 8 requires every workplace to have suitable and sufficient
lighting. The lighting in the workplace, should as far as is possible, be
natural.

Regulation 8 also states that suitable and sufficient emergency lighting
needs to be provided, where people are specially exposed to danger, in the
event of failure of artificial lighting.  It is for London Underground to
determine what emergency lighting (if any) is needed and where. ORR
regulates health and safety for the entire mainline rail network in
Britain, as well as London Underground, light rail, trams and the heritage
sector. Therefore in a railway context we are the enforcing authority for
the Workplace (Health, Safety and Welfare) Regulations 1992.

 

2. Is keeping untruthful records about emergency lighting a criminal
offence under HMRI regulations?

There is no specific requirement under health and safety regulations to
keep records relating to emergency lighting. There may be requirements
under fire safety legislation but LFB would need to be consulted on such
matters.

As a general principle where an organisation is required to keep records
(or opts to do so) such records should accurately reflect the conditions
existing at the time the record is created.

 

3. Could London Underground, Earl’s Court station be kept open if there is
an emergency lighting failure?

The Health and Safety at Work Etc Act 1974, The  Management of Health and
Safety at Work Regulations 1999 and the Railways and Other Guided
Transport Systems (Safety) Regulations 2006 all require risk assessments
to be carried out by employers. These laws oblige London Underground to
determine, on the basis of such risk assessments, whether or not a station
without emergency lighting available may continue to operate.

As previously stated, there may be specific requirements under fire safety
legislation and LFB would need to be consulted on such issues.

4. What is the HMRI regulation on the emergency lighting at stations?

As indicated previously there are no railway-specific requirements
relating to emergency lighting.

 

5. Who has the duty to implement these regulations?

It is the duty of the employer to implement health and safety legislation
and regulations. Sometimes duties are also placed on employees and the
self-employed.

6. If the offence was committed during the period between 2003 and 2016,
would you be prosecuting any offenders involved? If so, how do I report
it? Please

The decision whether to prosecute is carried out in accordance with the
Code for Crown Prosecutors and takes account of the evidential stage and
relevant public interest factors. No prosecution will go ahead unless an
approval officer finds that there is sufficient evidence to provide a
realistic prospect of conviction and that prosecution would be in the
public interest. Each case is individually considered on its merits before
