We are dealing with your request in accordance with the Freedom of
Information (FOI) Act 2000. We have been looking into the information
covered by this request, and it has become apparent this is very broad and
will cover an extensive range of our work over a long period of time, as
you have not specified a date range for relevant information.

 

To search for all the information necessary to answer your request would
require us to approach a wide variety of individuals and teams across
Ofsted. Each team or individual, as appropriate, would need to manually
search a large number of files and email accounts. This information would
then need to be reviewed to determine whether it contains other material
that may be exempt from disclosure, such as sensitive personal data.
Conducting a manual search of such a large volume of records and email
accounts, assessing the results of those searches, and then extracting
information within the scope of your request, would all take a significant
amount of staff time.

 

Section 12(1) of the FOI Act states that a public authority is not obliged
to comply with a request for information if it estimates that the cost of
complying with the request would exceed the appropriate limit (£600,
equivalent to 24 hours of staff time). Our initial assessment is that this
limit would be passed by your request in its current form. Therefore, if
we proceed with your request our likely response would be to refuse to
provide any of the information as to do so would exceed the limit above.

 

Where a public authority, such as Ofsted, is considering the use of
section 12, it is obliged under section 16 of the Act to provide advice
and assistance to the individual making the request, where possible. This
is why we are writing to you at this stage.

 

One way to initially narrow the searches would be for you to provide a
date range. Depending on the topics you are most interested in, it may be
that you could narrow your request – for example, by requesting
information linked to specific Ofsted activity, such as individual
inspections. You may alternatively wish to limit the scope of your request
in some other way.

 

On receipt of any revised request, we will consider whether we can locate
the information without exceeding the appropriate limit, and advise you
accordingly. Please note that revising your request to fall within the
limit does not guarantee disclosure of the requested information. On
receipt of any new request, we will consider what information can be
disclosed to the public, and whether any exemptions apply to that
information.

 

If you wish to submit a refined request, we would be happy to take this
forward for you. If you do not narrow or revise the scope of your request
by 3 January 2020, we would be likely to issue a formal refusal under
section 12 of the Act. That will not, however, prevent you submitting a
new revised request after that time.

Thank you for your email of 31 December 2019 in which you have provided a date range for your FOI request.

Although it is helpful that you have narrowed your previous FOI request by providing a time frame for the information you are requesting, to comply with your request, as it stands, would still exceed the ‘appropriate limit’ as set out under Section 12 of the Freedom of Information Act.

In order to search for emails matching your request we would still need to search the email accounts of every staff member and every team within Ofsted, within the timeframe provided, to see if emails matching your request are held. There are a large number of individuals and various teams that will may hold emails mentioning the schools, including for example, our inspection scheduling, complaints, regional office and other correspondence teams which we would need to search. Conducting a manual search of such a large volume of email accounts, assessing the results of those searches and extracting information within the scope of your request would take more than 24 hours of staff time.

In such circumstances where a public authority, such as Ofsted, is considering the use of section 12 it is obliged under section 16 of the Act to provide advice and assistance to the individual making the request.

This email is not a formal refusal of your request. However, we are unable to proceed any further with your request, as it currently stands. We are therefore emailing you to enquire whether you can further narrow or revise the scope of your request. It may be helpful if you could provide a focus of your interest, for example the type of correspondence you are seeking, so we could target a particular team for our searches rather than keywords. We do have a database where information about each school is stored under the registration number but this would not include correspondence held individually and in all teams which would all need to be searched separately.

Finally, if you do decide to retain keyword searches in a revised request, with regard to your final bullet point “Steiner Waldorf Schools Fellowship (SWSF) -Secondary/upper school provision/closure” it would be helpful if you could clarify the information you are seeking. It is not currently clear whether you intend this to be separate search terms.
