Dear Bristol City Council,

In his statement to DCA on 20th September, Cllr Plowden alluded to important email(s) exchanged between himself and Cllr Richard Eddy in the days following the 5th July meeting of DCA, which prompted Cllr Plowden to review the governing rules & guidelines for Development Control committee members. It was not clear whether the email was exclusively between the 2 Cllrs, or if others were also included. Please can all email exchanges between Cllr Eddy, Cllr Plowden and their fellow members of DCA be released for public scrutiny forthwith?

Dear Laura Chapman,
 
With apologies for our delayed reply, please find attached the information
held within the scope of your request, which has been considered under the
Environmental Information Regulations (EIR) as it relates to a matter of
planning/redevelopment. Please note that some names/details have been
redacted as we are of the view that they constitute personal data.
 
Please also note that around 100 pages of further e-mails which may fall
within the scope of your request have been withheld under Regulation
12(4)(e) of the EIR, which states that 'a public authority may refuse to
disclose information to the extent that […] the request involves the
disclosure of internal communications'.
 
To use this exception we undertook a public interest test. The matters
which were considered in applying that public interest test are as
follows:
Factors in favour of disclosure:
 
- There is a general presumption in favour of disclosure within the EIR.
- There is public interest in planning and regeneration matters generally
and this planning application in particular.
- There is public interest in the Council's decision-making processes in
general and in relation to the accountability and scrutiny of elected
members, including members of planning committees, in particular.
 
Factors in favour of withholding:
 
- There is public interest in the Council, including elected members and
those on the planning committee, having a safe space for discussion.
- There is already significant information in the public domain, including
in relation to previous information requests, about this application.
 
It is considered that the greater public interest therefore lies in not
providing the information at this time. In coming to that conclusion, the
public interest in providing the information has been carefully weighed
against any prejudice to the public interest that might arise from
withholding the information; in all the circumstances of the case, the
public interest in maintaining the exemption outweighs the public interest
in disclosing the information.
 
This response therefore acts as a refusal notice under regulation 14 of
the EIR.

Hi Laura. This public interest test from Bristol City Council really looks very weak. Have you considered submitting a request for an internal review?
