I write in response to your email of 9 August 2016 in which you submitted
an information request to the ICO. Your request has been dealt with in
accordance with the Freedom of Information Act 2000 (FOIA) and our
response is below.
 
Your request
 
In your 9 August email you asked;
 
“Please can I request all emails held by the ICO which come up by doing a
keyword search for the 'named person scheme”
 
Our response
 
I can confirm we hold information falling within the scope of your
request. I have attached to this email as much of the information that we
hold that we are able to disclose. Where possible I have removed duplicate
pages where these appear in the email chains provided.
 
In processing your request we have searched the email accounts of our
staff for all emails that come up by doing a keyword search for the phrase
“named person scheme”. It may be helpful to explain that searching in this
way will not capture all information the ICO holds on this subject, only
those emails where the phrase “named person scheme” appears in either the
subject line or body of an email.
 
I should add that we use an electronic case management system to track and
progress individual cases including the individual complaints and concerns
that are reported to us. Unfortunately we are unable to search this system
in the way you have requested as it does not have a search function that
allows searching for emails by using a specific phrase.
 
Some information has been withheld from this response. Firstly we have
withheld a small amount of personal data relating to third parties
including some junior members of ICO staff in line with our policy on the
disclosure of information about ICO employees. A copy of this policy is

This information has been withheld in accordance with section 40(2) of the
FOIA, which by virtue of section 40(3)(a)(i) allows a public authority to
withhold the personal information of individuals other than the requester
where disclosure would breach a data protection principle. In this case,
we don’t think disclosure of this personal data would be fair and would be
in breach of the first data protection principle.
 
Additionally some material has been withheld under section 21 of the FOIA
as this is information reasonably accessible to you by other means.
Section 21 of the FOIA states:
 
“Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.

(2) For the purposes of subsection (1)—
(a) information may be reasonably accessible to the applicant even though
it is accessible only on payment”

Specifically we have withheld some emails that ICO staff had received as a
result of subscription based services to which the ICO is a corporate
subscriber. These are predominantly newsletters / case law updates
covering developments in information rights law that refer to the Supreme
Court judgement about the named person scheme.
 
I have listed below the websites of the relevant subscription services
where you can also subscribe to view these newsletters and receive future
updates. Specific information about how to subscribe to each publication
is available on each of the relevant websites.
