Dear Mr Walker
I am writing regarding your request for information, which I received on 5th September 2012.
In that request you asked us for copies of all e-mails sent by specified employees since 1 January 2012, with e-mail histories intact.
I can confirm that the Chief Executives, Communications and IT departments holds information falling within the description specified in your request. However, we estimate that the cost of complying with your request would exceed the appropriate limit of £450. The appropriate limit has been specified in regulations. This represents the estimate cost of one person determining whether the Department holds the information, and locating, retrieving and extracting the information. Under section 12 of the Freedom of Information Act the Trust is therefore not obliged to comply with your request and we are unable to process your request further.
If you were to make a new request for a more narrow category of information, it may be that we could comply with that request within the appropriate limit, although I cannot guarantee that this will be the case, and it may help if I outline some possible ways of narrowing your request.
1. Limit the request to specific subjects and/or
2. Reduce the date range and/or
3. Specify recipients

Dear Richard,
Thank you for your message. It takes a matter of minutes rather than hours to copy across the sent or received emails from Outlook or any other email-management software, and even if the number of emails is large it's not going to reach anything like 18 hours' worth of work to do it.
To help narrow the request slightly, you can amend the time range to the last 6 months, but even this shouldn't really be necessary, given the capabilities of even moderately up-to-date software and hardware.

Dear Sir/Madam,
I received your decision and note that you pre-checked it with the ICO office.
You refused my request on cost grounds, on the basis that it would take 1 man hour to obtain the information, but 'disproportionate effort' of appr. 100 hours to remove information that the Trust wanted to exempt.
However, your Trust's own legal guidance on FOI requests, as provided by Bevan Brittan to the SWC and then circulated by SWC to all member Trusts, is that exemptions for effort and cost can ONLY be based on the time to obtain the information and NOT for time required to identify information you wish to exempt. According to your refusal document, the time required to extract the information is only 1 hour - well short of the 18 hour limit.
I have complained to the ICO about the decision on this basis, but am writing to give you a chance to reconsider your decision and so to obviate the need for the complaint process.
