enclosed.
Dear Mr Thatcher
You have requested the following information: “email communications
between the environment agency and yourselves associated with moorings in
Elmbridge, to include cherry orchard gardens, unconsented moorings and/or
the environment agency stating that they will bring legal action at the
end of October to claim land from 01/10/2022 to today's date.”
Please find attached the information requested. It contains communications
between the Environment Agency (EA) and the Council. To clarify we have
not included information that has been sent to the Council for the
attention of the EA from third parties as this is not communications
between the EA and the Council. The attached has been redacted and does
not include all correspondence relating to Cherry Orchards because
exemptions are engaged in relation to that information under s30 and s31
(investigations and prejudice to law enforcement), s41 (confidentiality)
and section 40(1) (personal data) of the Freedom of Information Act 2000.
These exemptions are subject to the public interest test, with the
exception of s40 which is an absolute exemption. There is a general
presumption in favour of disclosure unless factors strongly suggests
otherwise. To disclose would prejudice the officer(s) carrying out their
investigations and regulatory enforcement effectively and prejudice the
voluntary disclosure of information by those with a reasonable expectation
that this information is given in confidence and would not be disclosed

Good afternoon, please may I kindly request the attachment be resent as it will not open in html or download.
May I also request an interview review of the redacted information. The integrity of the council working for the benefit of its constituents and not working against them is essential to local government. Concerns that the environment agency and local councils conspire against those they have a duty of candour is naturally a matter for public scrutiny. Particularly if there is found to be an improper association that could have nation wide implications. Submitted for your careful consideration.
