Electoral register and email addresses

Response to this request is long overdue. By law, under all circumstances, Eden District Council should have responded by now (details). You can complain by requesting an internal review.

I am interested to know whether:

(a) You hold personal email addresses as part of your Electoral Register, and if so,

(b) how many emails you hold in the Electoral Register;

(c) What the source or sources of these emails is;

(d) Whether you have included all or some portion of these emails as part of the datasets you gave to election candidates at the 2019 General Election;

(e) If so, how many emails were supplied;

(f) Whether you supplied email details in other prior elections.

Thank you for your request under the Freedom of Information Act 2000
received on 10/Dec/2019. I have registered your request under reference
number FOI 06578 and would be grateful if you would please use this

Whilst it is the Council’s policy to provide information wherever
possible, I need to advise you that there are a number of exemptions under
the Freedom of Information Act 2000 which may prevent the release of some
or all of the information you have requested. Some exemptions are absolute
and some only apply where the public interest in maintaining the exemption
outweighs that in disclosing the information. You will be informed if this
is the case and the reason why.

Once the information has been identified the Authority may also ask that a
fee be paid for processing and delivering the information to you. Details
of any fee to be charged will be notified to you as soon as possible.

Dear Jim

Thank you for your request which has been logged under FOI Ref No 06578. However, please note that we will not be treating this as a request for information under the Freedom of Information Act, as the Electoral Registration Officer’s role falls outside of the legislation. Your email has been forwarded to our Elections team, who will look at the request as part of their normal business.

The Registration of Electors is governed by the Representation of the People Act 1983 as amended. Under Section 8 of the Act, a council must appoint one of its officers to be the Registration Officer for any constituency or part of a constituency coterminous with or situated within the council's area. Any appointment as Electoral Registration Officer is separate to any other appointment and although appointed by the council, the Electoral Registration Officer's responsibilities and duties are personal. An example of this is that the Register of Electors is deemed to be the property of the Electoral Registration Officer, not the local authority. The Electoral Registration Officer does not carry out the duties on behalf of the local authority but in his own personal capacity.

The Freedom of Information Act does not list any person appointed under the Representation of the People Act 1983. It follows that the Electoral Registration Officer, Returning Officer or any other person appointed under the Act are not subject to the provisions of the Freedom of Information Act.
