We have considered your request and our view is that your request is
invalid. Your request contains a series of questions rather than specific
requests for information.

 

The Freedom of Information Act gives people the right to access recorded
information. The Act does not give people a right to be given answers to
questions that they would like to put to a local authority if this would
mean creating new information or would involve giving opinion or judgement
that is not already recorded.

 

Although you have indicated that you wish to make a request for
information, further to your 'right to know' contained in section 1 of the
Freedom of Information Act 2000 (FOIA), your email contains an enquiry
rather than a specific request for recorded information held by Haringey
Council.

 

Guidance given by the Information Commissioner’s Office (ICO) states that
requests which are not for recorded information, but instead ask
questions, such as "please explain your policy on x" or "please explain
your decision to do y" are not requests for recorded information and
therefore should be treated as routine correspondence."

Thank you for your response to my recent FOI request.

However, I feel that perhaps you have misinterpreted what I am asking for. I will try to clarify my request below.

For background, I am not looking to obtain any contracts with the council, nor do I ask you to explain anything or give an opinion. I am interested in home education and am trying to obtain information you hold.

I believe the FOIA allows me to request the following information:

1) Has the local authority outsourced all or any part of its duties and responsibilities in relation to Elective Home Education to third party organisations in the years (from 1st January to 31st December) 2016, 2017 and to the date of this FOI? Please specify in which years EHE services have been/are outsourced. This is pertinent for the below information requests.

2) If yes, please provide role profile/job specs for roles outsourced?

3) Please provide a list of which third party organisation/s held or currently hold contracts with the local authority, and the dates when these contracts end?

4) Please provide information on how much the local authority paid for these services for each year specified?

If, after receiving this, you still feel my request is invalid, then I would be grateful if you could tell me which part of my request is seeking explanation or opinion. The only question I ask is in part 1), which if the answer is "no", then the remainder of the request is not required.

Haringey Council have not outsourced any duties or responsibilities in
relation to Elective Home Education to third party organisations in the
years 2016/2017 to date.
