to "provide the Lord Advocate’s office with essential information in his

the Lord Advocate the Freedom of Information Act may not be the most
appropriate mechanism to use. The Lord Advocate's Office is a Public
Authority in its own right under the Freedom of Information (Scotland) Act
2002. There is an established convention that the Ministry of Defence
follows in meeting requests for information from other UK based Public
Authorities, under which we would provide information required for
official purposes outside of any FOI legislation. This convention allows
Public Authorities to share information required for the effective conduct
of public affairs that might not normally be released publicly.  

 

We would be grateful if you could clarify if you are making the request on
your own authority, or are formally acting on behalf of the Lord Advocate.

Dear CIO-FOI-IR (MULTIUSER),

A meeting took place on 1st May at the Scottish Crown Office between myself, Richard Lochead MSP and Mr David Green, Head of the Scottish Fatalities Investigation Unit. It was made clear by Mr Green that it was important that all relevant information relating to the 2012 Tornado collision be collated so that the Lord Advocate can make a final decision regarding a renewed call for an FAI into the accident.

Subsequent to that meeting I advised Mr Green that certain important documents are being withheld from me on the grounds that my requests are considered to be vexatious. I asked him to intervene but he has advised me that I should pursue the matter as advised under rights to review; hence my latest request.

So in answer to your final point, I am technically making the request on my own authority in order to provide David Green, and ultimately the Lord Advocate with essential technical data. Should you decline this latest request I will advise Mr Green of the alternative method of obtaining the documents

 5. Further to my earlier email of this date can you advise me as to what

FOI2018/09749.

 

All have a statutory 20 working day target date of 14 August 2018.

Many thanks for your reply. The highlighted sections of the worksheets are of great help. Can you advise me as to the revision date of the worksheets?

I note the emphasis is on the BTTDFU but it was my understanding that this unit was replaced by the Gas Fired Time Delay Unit (GFTDU) under Mod 02198. Can you advise? Also, are there diagrams to go with the worksheets? There is constant references to item numbers which I assume relates to a drawing(s).

All the worksheets relate to bay servicing, is it possible to be provided with aircraft servicing documentation covering seat fitment including cartridges?

The 2002 QinetiQ report, covering Mods 02197 and 02198, lists MBEU 98777 and MBEU 62377-2 as being the revised cartridges. However, a recently obtained copy of the aircraft ejection seat servicing procedures (dated Jan 2012) state the following;

ON PRE MOD. 02198 EJECTION SEATS, ONLY PRE Mod. 02197 CARTRIDGE SETS (CARTRIDGE SET, EJECTION SEAT NO.16 MK.1, PART NO. MBEU 60008-4) ARE TO BE USED.

ON POST MOD. 02198 EJECTION SEATS, ONLY POST Mod. 02197 CARTRIDGE SETS (CARTRIDGE SET, EJECTION SEAT NO.16 MK.2, PART NO. MBEU 115904) ARE TO BE USED.

These numbers seem to be at variance with those specified in the QinetiQ report; are they the same cartridges? .

Cartridges are procured and fitted as complete sets which are made up of 11 individual cartridges. Cartridge sets have a part number, and each individual cartridge within that set also has its own part number.

In relation to the extracts below from the servicing procedures, MBEU 60008-4 relates to a cartridge set (the pre 02197 modification cartridge set) as does MBEU 115904 (the post 02197 modification cartridge set).

The QQ report points to the part numbers of two individual replacement cartridges (MBEU 98777 and MBEU 62377-2 ) within cartridge set MBEU 115904 for use on post modification 02198 ejection seats.

Regarding your recent reply on cartridges.

I now fully appreciate that cartridges come in box sets of 11, can it be assumed that they are 'keyed' in some way for fitment into the respective breech, or at least colour coded. Schedule simple states "insert into breech" for correct mod state.

Also, can you advise me as to how often seat maintenance takes place? I have seen 3 years mentioned, but that seem a long time. Do your records indicate when the seats involved in the 2012 Tornado collision underwent 'on aircraft' maintenance?

Please could I have a copy of Aircraft Maintenance Manual Chapter 29
Emergency Equipment, DAP 101B-4104-EP Issue 42, November 2013.

 

I wrote on 22 October to advise you that as this is a NATO document we
believe some of the information falls within the scope of qualified
exemption Section 27 (International Relations) and therefore it is
necessary for us to decide whether the public interest in maintaining the
exemption outweighs the public interest in disclosure. I regret to inform
you that our investigation is ongoing and I estimate this will take an
additional 20 working days. We therefore plan to respond by 17th December
2018.
