EIR – Specification for Canterbury District Place Strategies (DN772629)
Dear Canterbury City Council,
Please treat this as a request under the Environmental Information Regulations 2004.
I am requesting a copy of the tender specification and any associated brief or supporting documents issued by Canterbury City Council under opportunity reference DN772629 – “Canterbury District – Place Strategies”, as advertised on the Kent Business Portal (Proactis).
As the content of this commission clearly relates to town centre strategy, land use, public realm and the built environment, it constitutes environmental information under Regulation 2(1) of the EIR 2004.
I understand the tender is currently live, however this does not exempt the specification from disclosure. In particular, I ask the Council to note the following:
• If Regulation 12(5)(e) (commercial confidentiality) is being considered, it must meet all four legal tests: the information must be genuinely confidential, protected by law, commercial in nature, and disclosure must demonstrably harm a legitimate economic interest. This is rarely met where the information is already made available to multiple tenderers or is not marked confidential.
• If the Council relies on any exception, please specify the exact regulation being applied, the rationale for doing so, and provide a clear public interest test as required by Regulation 12(1)(b).
• If only part of the information is considered exempt, I request redacted disclosure of the remainder in line with Regulation 12(1)(a) and 12(2)(c).
This request is made in the public interest, given the Council’s longstanding public commitments to develop place-based and town centre strategies and the likely impact of this work on the built environment of Canterbury, Whitstable and Herne Bay.
