Please provide me the following information:

1. How many requests were received by Haringey SEN department for EHCPs in 2015/2016, 2016/2017 and to date during 2017/2018 ?

2. How many of these requests led to EHCP plans being issued?

3. How many:
(I) formal complaints relating to EHCP process;
(II) mediations
(III) cases to the SEND Tribunal against Haringey SEN
were made in relation to EHCP assessments and final EHCP in 2015/2016, 2016/2017 and to date during 2017/2018?

4. How many of the cases brought in the SEND Tribunal in 2015/2016, 2016/2017 and to date during 2017/2018 were:
(I) found in favour of Haringey SEN
(ii) found in favour of the Claimants?

5. In cases where the Tribunal found in favour of the Claimants, how much did Haringey have to pay for the Claimants' legal costs in 2015/2016, 2016/2017 and to date during 2017/2018?

We are not able to give you a precise number in response to this question
because of the very low numbers of people involved and therefore the
possibility that the individuals involved could be identifiable.  If it
were possible to identify the individuals involved (from the information
that we provide and other information that may be available to people) it
would be a breach of the Data Protection Act to disclose the information.
Where it would breach the Data Protection Act to disclose information,
that information is exempt from the Freedom of Information Act under
Section 40(2).

Our general approach is not to provide a number when that number is 5 or
less in order to minimise the risk of identification.  I can therefore
confirm that it was less than five but cannot be more specific.

 

You may also complain to the Information Commissioner’s office, who may be
able to help you.  However they would normally expect the Local Authority
to have undertaken a complaint investigation or Internal Review of the
request before they will accept the referral.
