RESPONSE

 

Source data: Local Authority pupil database since Sep-14 up until 30^th
June 2016

 

1.    667 conversions to an EHC Plan finalised.

443 EHC Plans finalised following a new statutory assessment request.

 

 

2.    Not all statements current as at 30 June 2016 will result in an EHC
Plan being issued. Total number can change due to pupil’s moving into the
authority, moving out of the authority and in some cases a decision made
not to issue an EHC Plan following transfer review.

 

1752         Statement of SEN still to be reviewed/finalised.

83    LDA conversion requests ongoing where a decision has been made to
issue an EHC Plan but not yet finalised.

    56    New ongoing assessment requests where a decision has been made
to issue an EHC Plan but not yet finalised.

 

 

3.    Section 12 FOIA 2000 provides that a public authority is not obliged
to comply with a request for information if it estimates that meeting the
request would exceed the appropriate cost limit. This ‘appropriate limit’
is set out in the Freedom of Information and Data Protection (Appropriate
Limit and Fees) Regulations 2004. The ‘appropriate limit’ for non Central
Government public authorities is currently set at £450. In relation to
staff time, this is calculated at a rate of £25 per member of staff per
hour. This effectively equates to a time limit of 18 staff hours.

 

To ensure an effective assessment of the time it would take to respond to
your request, I have asked the relevant officer to estimate how long it
would take for them to identify and locate the information you seek. The
estimate for responding to your request exceeds 18 hours and therefore
exceeds the ‘appropriate limit’. Where a public authority estimates that
responding to the request would exceed the appropriate limit, there is no
obligation on the public authority to carry out searches up to the 18 hour
limit. Section 12 effectively removes the information from the scope of
the duty to disclose altogether.

 

Given the number of conversions completed (667) and new EHC plans
finalised (443) from Sep-14 to Jun-16; in order to identify how many
include Health and Social Care in the final completed plan would require a
manual trawl of each database record. i.e. to access the database record,
identify the final version of the Microsoft word EHC Plan document, review
content of EHC Plan and collate the response. Assuming that it would take
between  1 and 2 minutes per case, this would equal 37 hours.
