Dear Northumberland County Council,

Under Regulation 13(2) of the Special Educational Needs and Disability Regulations 2014 you are required to send out a copy of the finalised EHC plan as soon as practicable, but in any event, within 20 weeks of the local authority receiving the request for a EHC needs assessment.

Can you please provide the number of Educational Health Care Needs Assessments (EHCNA) that Northumberland County Council (NCC) has failed to finalise within 20 weeks of them receiving the request for the following time periods:

A. For the last full year, 1st January 2022 to 31 December 2022; how many EHCNA assessments have been finalised after the 20 weeks time scale?

B. For the last full year prior to the covid 19 pandemic, 1st January 2019 to 31 December 2019; how many EHCNA assessments have been finalised after the 20 weeks time scale?

For all of the above responses please exclude any applications where any of the exceptions contained in Regulation 10(4)(a) to (d) apply.

Right of Access 

 

Section 1(1) of the Act provides any person making a request for
information to a public authority is entitled. 

 

(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request (which Section
1(6) of the Act designates as the "duty to confirm or deny"), and 

 

(b) if that is the case, to have that information communicated to him. 

 

The right is to obtain access to the information itself and not to the
document or record which contains it. 

 

The Act creates a general right of access to information held by public
authorities subject to various exemptions.
