EHC assessments and social care advice and information

We're waiting for Educational Rights Alliance (ERA) to read a recent response and update the status.

Dear Leeds City Council,

Regulation 6 Special Educational Needs and Disability Regulations 2014 sets out the advice that the Local Authority must secure as part of an Education Health and Care Needs Assessment. Part of that Regulation requires that advice and information in relation to social care is obtained during the EHC Needs Assessment.

Please advise the following with regard to EHC Needs Assessments from Sep 2014 to date, on a year by year basis. Do include new applications and transfers from Statement of SEN and LDA.

1. How many EHC Needs Assessments were carried out?

2. How many of (1) included a social care assessment?

3. How many of (2) were new to social care?

4. Where a social care assessment was NOT carried out as part of the EHC Needs Assessment for a child or young person NEW to social care, what social care advice was provided?

I refer to the above and your request dated 16 October 2017. I have
contacted the relevant services and now provide a response to the
following request.

 

Please advise the following with regard to EHC Needs Assessments from Sep
2014 to date, on a year by year basis. Do include new applications and
transfers from Statement of SEN and LDA.

 

1. How many EHC Needs Assessments were carried out?

01/09/2014 – 31/08/2015: 329

01/09/2015 – 31/08/2016: 369

01/09/2016 – 31/08/2017: 500

 

2. How many of (1) included a social care assessment?

I am unable to provide a response to your request as we estimate that it
would take us over 18 hours to retrieve and locate the information you
have requested. Therefore your request falls above the “appropriate
limit”. This limit is set by fees regulations at £450 (equally 18 hours)
for public authorities such as ours and is calculated using a rate of £25
per hour which is also prescribed under the same regulations. As a result
under Section 12(1) of the Freedom of Information Act we are not obliged
to provide the information which you have requested.

 

We are however, still obliged under Section 1(a) of the Act to inform you
whether or not the information in question exists. The information request
is not held electronically and therefore we would have to go through each
of the above 1198 assessments and cross-reference these against our social
care case records to determine a response to your request. We estimate
that the retrieval of this data would take longer than 18 hours and
therefore we are unable to supply this information.

 

3. How many of (2) were new to social care?

See above response to Q2.

 

4. Where a social care assessment was NOT carried out as part of the EHC
Needs Assessment for a child or young person NEW to social care, what
social care advice was provided?

See above response to Q2.

 

I trust that this response is satisfactory. If however you are
dissatisfied with this response you have a right to appeal to an
independent officer within Childrens & Families. They will re-examine your
request and assess whether we have adhered to the requirements of the act.
