In February 2020, I submitted a Freedom of Information request to
Yorkshire Water concerning water pollution at Hay-a-Park SSSI in

Your responses stated that an investigation into this matter (including a
misconnection survey) was to be carried out. Can you please provide any up
to date information resulting from your investigations, in particular the
results of the misconnection survey?

 

“I can confirm that since your previous EIR submission in February 2020
(EIR Reference 222) our Customer Field Service Team commissioned an
investigation, including a misconnection survey. During our investigation
we have not located any signs of misconnections, despite many site visits
and tracing. Observations by YW at the outfall have noted general
household litter mixed with rotting vegetation leaves which are not
associated with misconnected foul appliances.”

Dear EIR Compliance,

Thankyou for your prompt reply dated 9th September 2020. I appreciate your efforts with regard to the misconnection survey and it is good news that you have found no systematic sewage pollution at the inflow to the SSSI.
However, the fact remains that your surface water discharge pipe is releasing a polluted effluent into a SSSI, a site reliant on good water quality to support its notified species.
In your response to my previous FOI request you stated that 'Environment Agency guidance says that you do not need a permit to discharge uncontaminated water, for example, clean rainwater from roofs or small areas of hardstanding to surface water or to discharge uncontaminated water collected from public roads and small parking areas (that’s been through a maintained oil separator or sustainable urban drainage system) to surface water' (https://www.whatdotheyknow.com/request/a...).
Despite the apparent absence of a misconnection, the effluent entering via the inflow pipe cannot be considered uncontaminated by any definition. The discharge regularly contains rotting vegetation, plastic fragments, wet wipes, and tissue paper and I have an extensive library of photographic and video evidence to demonstrate this situation. In addition, there is often a smell of detergent at the pipe entrance and sewage fungus was observed at the pipe outflow on 24th July 2020. Given your commitment to ‘protecting the environment and reducing pollution’ can you give details of any work carried out (or proposed future work) to improve the quality of the effluent at the Hay-a-Park SSSI.

Please find attached the data the response to your question submitted on
the 15 September 2020:

“Given your commitment to ‘protecting the environment and reducing
pollution’ can you give details of any work carried out (or proposed
future work) to improve the quality of the effluent at the Hay-a-Park
SSSI.”

 

I can confirm that the information previously provided to you under EIR
requests; 222, 236 and 274 is all the information we hold in relation to
works carried out and that there are no proposed future works, as such we
have applied exemption 12(4)(a) no data held.

 

We will monitor the area and respond to issues as and when they arise /
are reported to us. We encourage individuals to report these incidents
following our usual process and contacting our call centre. We also ask
that the individual record the data to share with us when we attend. In
the instances reported we have investigated fully and reported back on any
impact or issue and have explained how hard it is to locate and remove
misconnections from the system.  We currently have none identified as
there is no evidence to show any issue at this time.

 

After speaking with my colleagues in this department I can offer to
arrange a meeting for you with the Operational Field Manager on site. If
you would like to meet to discuss your concerns, please can you send me an

share these with the Operation Field Manager to arrange a suitable date
and time.
