Efficiency of finance administration regarding claims for Business Mileage

University Hospitals Birmingham NHS Foundation Trust did not have the information requested.

Dear University Hospitals Birmingham NHS Foundation Trust,

I am aware that you deal with the claims for Business Mileage and Subsistence Expenses submitted by employees of the Oxford Radcliffe Hospitals NHS Trust. Please may I have the following information with regard to those employees.

1. During the 12 month period to 31 December 2012, how many of those employees submitted motor vehicle expenses claims for business mileage?

2. For such claims made during that period,

a) How many employees by 28 February 2013 had been paid in full for mileage claimed at business rates?
b) How many employees by 28 February 2013 had been paid for the full amount of mileage claimed but with part or all of their claims being paid not at the business rates claimed but at the public transport rate?
c) For employees who claimed for payment at business rates, by 28 February 2013 how many had outstanding claims?
d) Of those employees who have been paid a part or all of their claim at the public transport rate where the claim had been made for payment at the business mileage rate, how many have been sent a letter informing them that the Trust has "details of a different vehicle held on our file to your actual claim" (or words to that effect)?
e) How many of those letters were sent to employees who had already provided the Trust with a Data Capture Form properly identifying the vehicle for the use of which the claim was made, a copy of the relevant V5 Registration Certificate and a copy of a Motor Insurance Certificate identifying business use cover?

I am writing to request an internal review of University Hospitals Birmingham NHS Foundation Trust's handling of my FOI request 'Efficiency of finance administration regarding claims for Business Mileage'.

The reason for this request is that it appears from information that I have obtained that your reply is either inaccurate or misleading.

Please confirm that the figure of 4486 used in response to my question 1, includes all claims whether or not they were rejected, disqualified or otherwise not dealt with.

Please confirm that with respect to my question 2(a) the figure of 4486 used in response to my question 1 includes all claims whether or not (and for whatever reason) they were rejected, disqualified or otherwise not dealt with.

It find it difficult to accept, in reply to your answer to my question 2(b) that if you have adjusted payments down from business mileage rates to public transport you have no record of having done so. It appears that at the least you have admitted to "dialogue" with employees which demonstrates that this information exists. Please identify this information as is required by law. Of the 433 expense claims paid at the public transport rate, please confirm how many were nevertheless claimed at the business rate.

In your answer to my question 2(c), please confirm that the nil response includes all claims whether or not (and for whatever reason) they were rejected, disqualified or otherwise not dealt with.

In your answer to my question 2(d), I repeat the observations that I have made above in relation to your answer to my question 2(b). If you have written to employees then the information requested must exist. Please identify it and provide it as is required by law.

It appears to me that your reply to my question 2(e) is nothing but obfuscation. Please answer my question simply without any extraneous reference to irrelevant information.

I would remind you that it may be a criminal offence to provide false or misleading information. Please identify those involved in producing the information I requested and in answering this request for a review.
