EEA Route Applications: Certificate of Application without the right to work

Dear Home Office,

I have not been able to find the information which I require on any government website nor via emailing the Home Office. I hope that this request under the FOIA will provide the information that I need. I wish to get access to any information held by the Home Office on the following issue, for example, training materials, meeting minutes, internal emails or caseworker guidelines etc.

My question is: Can you please provide the criteria that are used to decide whether or not someone who is applying for a residence card (EEA2) or confirmation of PR (EEA4) receives a Certificate of Application (COA) which indicates that they have the legal right to work in the UK?

I hope that you will provide as much detail as possible and make it clear whether or not being married is of consequence. I would also like to know whether or not the nationality of the EEA family member is relevant to the decision on wether to issue a short or a long COA.

#John, as the primary carer of a BC child or EU child, the parent should be granted the right to work as long as family relationship is show...

When my wife applied for a DRC she got a COA that couldnt confirm her right to work. I argued this, and they issued a new COA... although it took some persistance...

Also, ensure when you apply as an IRISH national you outline that you have not always resided in the UK or Ireland, but that you have excersised treaty rights (as the receipent of services ETC - Hotel or whatever) within (whichever member state)... be it a holiday, to spain or whatever.

A dual irish national does not need to complete Singh to the extents that Reg 9 requires... Regardless of whether the home office agree...

Dear NW Region FOI,

Thanks for your response. I, however, did not request that you collected any information, statistics or otherwise, in order to process my request. I want to find out policy information about how a decision on whether or not a COA with the right to work is issued.

I do not believe that this will take 3 days nor exceed the 600GBP limit as this information must exist somewhere already.

I will be complaining to the Information Commissioner about this.
