Please find our response below:

Can you please provide the following details:
- What is the total contract value, as originally contracted, and term in
years for your current Capita One education software system contract?

Our education services have advised that this information is commercially
sensitive and subsequently an exemption applies, details of the exemption
can be found below.

Freedom of interest S43: Commercial Interests
Section 43(2) provides an exemption from disclosure where to release
information would, or would be likely to prejudice the commercial
interests of any party (including the Public Authority holding it).
Disclosure of the requested information could prejudice pending or future
negotiations the Council may be subject to.
This is a qualified exemption under the FOI Act which means that
consideration must also be given to whether in all the circumstances of
the case the public interest favouring disclosure is greater than the
public interest in maintaining the exemption. The public interest means
what is in the best interests of the public not what is of interest to the
public.

Public interest test considerations
We have considered whether the public interest in maintaining the
exemption outweighs the public interest in disclosing the information.
There are a number of public interest arguments that weigh in favour of
disclosing the information you have sought:

• The general proposition of maximising openness that the FOIA and the
Council aspire to;
• The benefits of ensuring transparent and accountable government by
disclosing how the Council receives and spends public money;
However, there are also public interest arguments against disclosure:
• Releasing the requested information could prejudice the Council’s
current or future negotiation capabilities.
The public interest in withholding the requested information outweighs the
public interest in disclosure of the requested information.

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
made within 40 working days of the date of receipt of the response to your
original letter and should be addressed to:

I am writing to request an internal review of Vale of Glamorgan Council's handling of my FOI request 'Education Case Management System'.

I am unhappy with the section refusal as this information is freely available in the public domain. It is generally hidden deep in council website spreadsheets.

Please provide the very minimum information legally:

What is the total contract value (as originally contracted) of your current education management information system software solution (capita one) and term in years, including any extension options and when it is due for renewal

We write in relation to your request that the decision not to provide you with the information be reviewed. We confirm that this has now taken place. Further enquiries have been made with the relevant service area as part of this process. The information you seek is not within the public domain. We note that you disagree with this view, however you do not provide any information to support your view. In the circumstances it does not appear that the information is in the public domain.

You also objected to the section 43 exemption being applied. This relates to information not being disclosed because it is commercially sensitive. It is felt that the exemption has been appropriately applied.

We appreciate you will be disappointed by this response. We have given very careful consideration to the points you have raised but do feel it was appropriate that the exemption was applied.
