Thank you for your recent request which is set out as follows:
‘Please supply me in electronic form the Eco Park Surrey development
project monthly update reports regarding SCC and Suez for the 6 months
from February 2019 to the current one.’
We consider that your request for information falls to be considered as a
request for information under the Environmental Information Regulations
2004 (“EIR”)
We confirm that Surrey County Council does hold the information requested
but that we have decided to withhold some of that information under the
following provisions of the EIR.
Regulation 13 - Release of personal data
Regulation 12(5)(e) - The information is commercial or industrial in
nature; is confidential under either the common law or under contract or
statute; the confidentiality is protecting a legitimate economic interest;
such confidentiality will be adversely affected by disclosure; and the
public interest in maintaining the exception outweighs the public interest
in disclosing the information.
Please note that the most recent report we hold is from April 2019.

Dear FOI/COR/SCC,
Thank you for your response, however I would like to draw your attention to the fact that you cannot rely on Regulation 12(5)(e) if the information relates to emissions. You cannot redact this information!

I would also argue very strongly that figures that are redacted should also be made public as this is a signed contract involving huge amounts of public money, that is years late and over budget and beset with problems.
I await your prompt response with an un redacted electronic copy of each of the reports.
It also makes no sense that such a major project, beset with problems suddenly does not have up to date progress reports for the last 3 months- very questionable! When is the next report due please?

The redacted information is not considered to be information on emissions and the Service do not intend to issue un-redacted copies of the Reports. Please note that the public interest test within the Regulations does not apply to redactions made under Regulation 13.
