DWP providing benefit payment information to HMRC

Dear Department for Work and Pensions,

HMRC have informed me of the following:

'Our system is set up to automatically trigger a P800 income tax calculation, once all income details have been provided to us. Using Real Time Information (RTI), employers are now obligated to provide information to us on a regular basis and the final submission for the year should reach us no later than 19 May.
Department for Work and Pensions (DWP) do not provide us with RTI data, instead they provide payment information by 31 May.'

Please provide me with all recorded information, within the FOI cost limits, that gives information on the DWP's provision of payment information to HMRC by 31 May of each year.

Thank you for your reply.

Unfortunately the information you have provided is so vague and full of gobbledegook as to be practically useless. You stated the following:
'At the end of every tax year, DWP TAKES ACTION to determine the tax position of each existing ESA and JSA claimant. By no later than 31 May each year, DWP automatically notifies HMRC and the claimant accordingly.'

And what exactly does that mean? DWP 'takes action'? What action? 'DWP automatically notifies HMRC and the claimant accordingly' Notifies them of what?

For HMRC to issue someone an income tax refund that may be due they must have ALL income detail for that person for the previous tax year, including ALL benefit payment information in FULL.

Let me make this as simple as I possibly can for you: Does the DWP provide HMRC with ALL, that means ALL, not just some, of the benefit payment information that a benefit claimant has received in the previous tax year? If the DWP only provide SOME of the information, then HMRC cannot issue a tax refund. The DWP only provided HMRC with SOME of the benefit payment information for myself for the tax year 2014-15 and therefore I did not receive an automatic tax refund. I had to jump through multiple hoops to receive it, including doing your job for you - providing all benefit payment information to HMRC. If I had not done your job for you, without being paid I might add, I would never have received the income tax refund that I was due. This must be happening to countless thousands of low paid workers.
So, just to make it clear again, could you please just answer the following question, for clarification and outside of your FOI obligations:
Does the DWP ALWAYS provide ALL the benefit payment information for an individual to HMRC by May 31 of each year? If you refuse to answer this clarification question then we will all know the answer and the reason for your refusal.

So the DWP refuse to clarify the 'information' they have sent me. What a surprise. The DWP collaborates with HMRC to actively defraud the working poor. Yes, you heard me right DEFRAUD the working poor.
Now that you have indirectly confirmed this with your typical 'no comment' (guilty as sin!)ruse I will pursue you both via the adjudicator's office and then the Ombudsman, and then further if necessary.
