Duty of care for contractors

Response to this request is long overdue. By law, under all circumstances, West Berkshire Council should have responded by now (details). You can complain by requesting an internal review.

under freedom of information can you please confirm

under your enforcement contracts for business rate collections the council has a duty of care for the debtor or victims of any errors via the

Local authorities (contracting out of tax billing, collection and enforcement functions) order 1996

and this duty of care is indemnified by the enforcement agents in order to protect the public purse

Request for information: Duty of care for contractors

 

The Council’s Revenues and Benefits Manager has confirmed the following,
in response to your request:

 

The contractor must also undertake to indemnify the Council against all
claims, damage or losses which result from the contractors’ actions.

 

This is part of the agreement the Council has with the enforcement agents.

 

If you are unhappy with the way your request has been handled or the
outcome of your request, you may ask for an internal review. You should
contact The FoI Reviewing Officer, Strategic Support, Council Offices,
Market Street, Newbury RG14 5LD, email [1][email address] , within 40
working days, if you wish to request a review.

 

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
