Further to your request received on 31/05/2024, I confirm that the Council
has now considered your request under the Environmental Information
Regulations. For ease of reference, I will now address each of your
questions in turn.
What discretion does the Highways Act 1980 Section 184 give to the
authority to limit dropped kerb numbers and lengths on unclassified roads?

Under section 184 of the Highways Act (1980), the Highway Authority has
powers to regulate the way access is taken over the footway. Other acts
which support how highway authorities decide on the criteria for dropped
kerbs include: a) Local Government Act 1989, b) The Local Government Act
1989 (clause 12 of schedule 10) empowers the Council to grant approvals
for the construction of vehicle crossings. c) Road Management Act 2004 d)
Planning and Environment Act 1987
When will the authority be taking enforcement action to stop motor vehicle
crossing of pavements that lack dropped kerbs?
The council is currently reviewing its dropped crossing policy and will
include this as part of the evaluation.
