Thank you for your recent request for information relating to Decision to

Please find below, Sheffield City Council’s response to your request:
 
Drones are not banned but may not be flown from or above Council land
without permission granted by us. As a result we do not hold recorded
information relevant to your request.
Permission will only be granted where:

* Use of a drone device helps reduce risk in the workplace, such as
working at height
* Land and building survey work
* To undertake professional services such as festivals and events media
* Flying drones is regulated and requires Civil Aviation Authority
licences in certain circumstances. The operator must provide evidence
of any permission from CAA (or SCC permission would be conditional on
them obtaining it) before permission would be granted.

Dear FOI,

Thank you for a reply but the information given does not answer ANY of my questions

If you cannot answer all of the questions then you cannot enforce a ban on drones

If you are having difficulty understanding some of the questions please ask

Your reply shows you have no understanding of civil avaiation law, or any aspects of drones in general

Without official records and trail of paperwork and approvals to back it up, your ban by definition cannot stand

Drones are one of the most exciting hobbies to date, regulation is expected but just saying it is so without proof, cause, consultation, definition and correct publicity is not on

I will be also asking for an internal review, the paper trail is important

Dear Mr Mallett
 
In relation to your request for internal review, I am sorry that you are
not happy with the response you received. The intention of an internal
review is to consider if we handled your response in accordance with the
law and to consider if any decisions made, for example to refuse
information, were correct and still apply.
 
In this case of your request the Council highlighted its position in
regard to the use of Drones over Council Land and no exemption from
disclosure my applied in this case.
 
Your initial request asked for a copy information related to the decision
to “ban” the use of Drones from property owned by the Council.
 
The Council’s response confirmed the following position i.e. that the
flying of drones are not banned but we do place limitations on their use:
 
Drones are not banned but may not be flown from or above Council land
without permission granted by us. As a result we do not hold recorded
information relevant to your request.
Permission will only be granted where:

* Use of a drone device helps reduce risk in the workplace, such as
working at height
* Land and building survey work
* To undertake professional services such as festivals and events media
* Flying drones is regulated and requires Civil Aviation Authority

In your request for review you have expressed your concern that we have
not answered the specific questions raised in your request. Further to
these comments I highlight that as noted in our initial response that the
Council have not banned the flying of drones over Council land. We have
instead put in place arrangements where permission must be sought for the
use of drones. In this regard we do no hold the wider information
requested in your initial request and subsequent request for internal
review. I also note that the Freedom of Information Act 2000 provides a
right of access to recorded information and not specifically a right to
have questions answered if no underlying information in that regard
already exists.
 
As a landowner the Council can put in place restrictions on the use of its
land; but, as noted above the Council has not banned the flying of drones.
 
After reviewing your response, I am satisfied that this information is
available on the link provided below, and therefore cannot overturn the
exemption.  I am sorry if this is not the response you would have liked,
however, the Act has been correctly applied in this case.
