Drink / drug drive prosecution stats

Response to this request is long overdue. By law, under all circumstances, Avon and Somerset Constabulary should have responded by now (details). You can complain by requesting an internal review.

Dear Avon and Somerset Constabulary,

For ongoing road safety research, could you please provide a monthly breakdown from January 2017 to December 2019 on those arrested and subsequently charged (and ideally conviction rates also) with:
1) Excess alcohol - Contrary to section 5 RTA 1988
2) Drug driving - Contrary to section 5A RTA 1988

eg

January 2017
excess alcohol
arrested - 100
charged - 90
convicted - 80
Drug driving
Arrested - 20
Charged - 18
convicted -16

and so on each month to December 2019.

If in researching the figures it transpires that obtaining conviction data takes this request above the statutory timescales and means the request would be denied please disregard that part of this request. i am however hoping that appropriate searching of prosecution systems / PNC / QUEST for conviction data will be easily performed within the timescales

Yours faithfully,

Mr B

Dear Mr Bennett

Following the changes to Government advice, from Wednesday 18 March the
team who deal with requests for information under the Freedom of
Information Act will not be situated within Force Headquarters.

Currently we are asking you to reflect on whether it would be deemed in
the public’s interest to receive the information you have requested at
this time, diverting operational officers away from their normal duties to
provide you with a response. Could we ask you to please consider whether
you would be able to delay your request for information given the current
circumstances? If you would like to withdraw a request previously
submitted, please reply to this email.

We will continue to provide the best service that we can but if you have
made a Freedom of Information request, you may experience a delay in
receiving your response, as the organisation is diverting our resources to
help with Covid-19.

Thank you for your co-operation at this time.

Yours sincerely

Dear #Freedom of Information Requests,

Thank you for your update.

I fully understand the issues currently facing the service at this time and if it is acceptable to you I will gladly accept a delay in providing the information.
May I suggest I will recontact yourselves in 8-12 weeks asking for a review of whether you are in a position to provide the details then?

IF the Covid 19 situation has not improved and the demand on resources still outstrips resource availability then I will review at that time and delay further.

Due to the national research ongoing I can't currently completely withdraw my research as I will be analyzing the picture, locally, regionally and nationally and eventually be submitting the research via DfT, PACTS and into policing review at a national level hence the requirement for the data.

Yours sincerely,

Paul Bennett

Dear Mr Bennett,
Thank you for your reply we appreciate your understanding. Please re-contact us as you have suggested, hopefully we will be in a better position across the Constabulary to provide you with a response then.

For now we will close your requests and await further contact from you when we will be happy to process your request, I completely understand that you still require the information for your research.

Once again thank you for your co-operation.

Michelle

Thank you for your request for information (previous reference 343/20). Your request will now be considered and you will receive a response within the statutory timescale of 20 working days as defined by the Act. In some circumstances Avon and Somerset Constabulary may be unable to achieve this deadline if consideration needs to be given to the public interest test. If this is likely you will be informed and given a revised time-scale at the earliest opportunity.
