the transcript for a fitness to practise final hearing.

 

Your request has been handled under the Freedom of Information Act 2000
(FOIA).

 

Written transcripts are not routinely produced for all fitness to practise
hearings. They are prepared by an outside provider. In accordance with our
[1]FOI policy  we are not required to process requests for transcripts
that we do not already hold if the cost of producing the transcript
exceeds the cost limit under Section 12 of the Freedom of Information Act
2000, for the Health and Care Professions Council that is £450.

 

We do not currently hold a copy of the written transcript of this final
hearing. The transcript quote we have received for this final hearing is
£984.00. This exceeds the statutory cost limit. Please do let us know if
you wish to proceed with a request for the transcript of this hearing,
which we will process once payment has been received.

Your request has been handled under the Freedom of Information Act 2000
(FOIA).

 

Further to our email sent to you on 4 April 2023, when we advised that we
do not hold a copy of the written transcript of this final hearing, please
accept our apologies but this was incorrect. In another search of the
records held for this case we have found that we do hold the written
transcript, please find a copy of this attached.

 

Some parts of the hearing were heard in private. We are unable to release
to you the transcript for the parts of the hearing that were heard in
private. This is because we consider that the exemption in Section 40(2)
of the FOIA applies. I have set out below the exemption cited in more
detail to assist you to understand our position on disclosure.

 

Section 40

 

The exemption in Section 40(2) applies to personal data which relates to a
third party. Disclosure of this information would breach the principles of
data protection set out in Article 5(1) of the UK General Data Protection
Regulation (UK GDPR), in particular principle (a) that personal data
should be processed lawfully, fairly and in a transparent manner. The
individuals involved would not reasonably expect that we would further
disclose the transcripts of the matters discussed in private for
non-regulatory purposes. If the HCPC were to do so it would be unfair
processing, and this would not be lawful.

 

Once again, please accept our apologies for this error.
