'20. The Tribunal considered whether or not the conviction for possessing child exploitation material was a conviction which, if committed in England and Wales, would constitute a criminal offence.

27. The Tribunal has determined the facts as follows:

1. On 6 July 2020 at the District Court of Queensland, Brisbane, Australia, you were:

a. convicted of Possessing Child Exploitation Material contrary to Section 228D of the Criminal Code; Found Proved

b. sentenced to 12 months imprisonment suspended for two years. Found Proved

2. The offence outlined above, if committed in England and Wales, would constitute a criminal offence. Found Proved as amended

32. Mr Slack directed the Tribunal’s attention to the Judge’s sentencing remarks in which he states:

...

“Two of the images were in the more serious category, I agree. The maximum penalty is 14 years jail."

49. In light of the evidence before it, the Tribunal determined that there remains a risk of repetition. Dr Sandhu tried to blame others for his situation and has not taken responsibility for his actions and this lack of insight leads the Tribunal to conclude that it cannot be said that the conduct is highly unlikely to be repeated. Accordingly, there is a real risk of repetition.'
