'15. At the MPT hearing, the initial Tribunal found the entirety of the Allegation against him proved in that:

On 18 March 2016, when treating Patient A as in inpatient at the Hospital, Dr Shendi recorded in his medical notes that he:

a. had contacted the Consultant Urologist on call, Dr B, for advice on how to treat Patient A. Dr Shendi knew this was incorrect because he had not contacted Dr B.

b. were advised by Dr B to transfer Patient A to Derby Hospital for a nephrostomy. Dr Shendi knew this was incorrect because he had not
contacted Dr B.

c. contacted a middle grade doctor, Dr C, at Derby Hospital. Dr Shendi knew this was incorrect because he had not contacted Dr C.

d. were advised by Dr C that he could not accept the case, and Dr B should contact the Consultant Urologist in Derby Hospital directly. Dr Shendi knew this was incorrect because he had not contacted Dr B.

In or around July 2015, Dr Shendi told Ms D that he was diabetic so needed to go for his lunch as it was 12.00pm, or words to that effect. Dr Shendi knew this was incorrect because he was not diabetic.

Dr Shendi’s conduct described above was found to be dishonest.'

Review - Suspension, 12 months.

'28. The Tribunal also noted that there was a patient safety issue related to Dr Shendi’s dishonesty. The Tribunal agreed with the GMC that, given the absence of information from Dr Shendi and the fact that he had not accepted the finding of dishonesty made by the 2020 Tribunal, it could not be certain if Dr Shendi still maintained his position or if he had reflected upon his misconduct since.

29. The Tribunal determined that the need to meet the overarching objective required a finding of impairment, namely: to protect, promote and maintain the health, safety, and well-being of the public; to promote and maintain public confidence in the medical profession; and to promote and maintain proper professional standards and conduct for members of that profession.

30. The Tribunal therefore determined that Dr Shendi’s fitness to practise is currently impaired by reason of his misconduct.'
