I have now received two files of documents of complaints made against Dr Gwen Adshead to GMC which resulted in a finding outside FTP procedures. Also I now have copies of complaints made to other organisations about Dr Gwen Adshead and their responses.

I am not sure if I want to appeal your reply at this stage without looking at all the documentation I have in more detail.

Dear General Medical Council,

1. I wish to appeal against the decision not to release the complaints against Dr Gwen Adshead and GMC FTP Directorate replies to the complaints on the grounds that public interest was not followed.

2. Dr Adshead worked as Fitness to Practice Panelist. It is reasonable for public to expect doctors who sit on Fitness to Practice Panels not to have any findings against them irrespective of actual FTP hearings.

3. It is not serving justice to have a panelist who has experienced issues around patient consent and confidentiality later on judging another doctor on the issues of patient consent.

4. Was Dr Adshead elected or appointed to FTP panel? Please, provide the dates of her elected/appointed period.

5. Please, provide the copy of the declared interests by her.

In response to your request I confirm that Dr Adshead was appointed as a
panellist following an open recruitment round. Her contract dates were 8
January 2002 until 7 June 2007.

 

The last recorded entry on the register of interests for Dr Adshead is as

Dear Julian Graves (0161 923 6351),

Dr Adsehad was given advice by GMC FTP investigation section to get patient consent in writing before she publishes confidential information about her patients. She did publish something and patient denied there was any consent including verbal. Dr Adshead stated to GMC there was verbal consent.

Public interest test was not applied when answering my request for information and neither has Information Commissioners Awareness guidance 1 and 3.

Even if you did have Section 10 notice under DPA 1998 (and you do not)public interest in this case is overwhelming.

If you think you did apply IC Awareness Guidance please, indicate how you applied it to my request/your refusal.

IC is clear that refusal to provide information requested cannot be used to cover up for administrative failures such as using Dr Adshead to sit on FTP panels or failure to take the complaints to FTP hearing.

Please, reconsider your decision and provide the requested dates of the last decision by FTP investigation section.
