1. I would like to know what the GMC policy is on experts registered with the GMC recommending residency within the family courts.

2. I would like to know what the GMC policy is on experts registered with the GMC asking social workers what they wanted written in their reports.

3. I would like to know what the GMC policy is on experts registered with the GMC concealing suspected abuse from courts. i.e. knowingly downplay concerns, assist social services tamper with medical evidence.

4. I would like to know what the GMC policy is on experts registered with the GMC concealing disclosures of abuse told to them by a child. I.e. the child discloses abuse to them and they deny or conceal this from the courts. The child then reveals further down the line that he or she has previously told the expert witness what happened to him or her.

5. I would like to know what the GMC policy is on experts registered with the GMC advising courts that a parent is wrong to report to social services suspected abuse.

6. I would like to know what the GMC policy is on experts registered with the GMC taking young children to the toilet alone.

6. Regarding Dr Cooklin GMC number 0161037, how many complaints have been made against him.
a) How many have been upheld.
b) How many have been dismissed.
c) What were the outcomes and reasons why they were upheld or dismissed.

Thank you for your email dated 5 June 2015 asking for copies of GMC
policies and information relating to Dr Cooklin. I’ve considered your
request under the Freedom of Information Act 2000 (FOIA).

GMC Policy

We don’t have a policy as such for all the individual circumstances that
you mention. However we do have guidance for all doctors on being involved
as a witness in legal proceedings as part of [1]Good medical practice.

Dr Alan Cooklin (0161037)

Publically available information about a doctor’s registration is on our
List of Registered Medical Practitioners (LRMP), which can be found on our
website: [2]www.gmc-uk.org. The LRMP lets you check a doctor’s
registration status and information about a doctor’s fitness to practice
history. I’ve attached a copy of Dr Cooklin’s LRMP record which shows that
they have no previous action on their registration. 

I can’t confirm whether we hold information other about Dr Cooklin because
it would breach the Data Protection Act 1998 (DPA) to do so. 

We believe it’s reasonable for doctors and complainants to expect that
complaints will be treated as confidential. It is only if a case
progresses to a public hearing, or the doctor receives a sanction on their
registration, that certain information may be made publicly available by
the GMC. Where this doesn’t happen the information remains the
confidential personal data of the doctor and other parties involved. I’ve
given details of the exemption under the FOIA which applies below. 

The exemption 

Section 40(5)(b)(i) of the FOIA applies where the information, if held,
would be the personal data of a third party and where confirming whether
it’s held would breach any principle of the DPA.  I believe that to
publicly confirm or deny whether we hold the information would breach the
first principle of the DPA, which requires that the processing of personal
data is fair and lawful. I believe the conditions in Schedule 2 of the
DPA, which are about the processing of personal information, are not met
and therefore giving you the information would be unlawful.

Your right to appeal 

I'm sorry I couldn’t provide all the information you requested. You can
appeal against this decision to Julian Graves, Information Access Manager.
