Dear Frinton and Walton Town Council,

As you will be aware there is a requirement for Town Councils to publish a register of declarable pecuniary interests of their members. These interests are governed by the Localism Act 2011 and The Relevant Authorities (Disclosable Pecuniary Interests) Regulations 2012. Your website does not declare these but refers to Tendring District Councils website. In turn Tendring District Council's website refers to your website.

Please treat the request as a freedom of information request as governed by the Freedom of Information Act 2000.

I require to see the registers of disclosable pecuniary interests of all members of the town council. Please furnish this in an accessible electronic form -I would suggest that perhaps you could publish your members interests on your website and then refer me to that in the response to this request.

Dear Sirs,

Our Code of Conduct requires our Members to send their Declaration of Pecuniary Interests to the Monitoring Officer at Tendring District Council. Only a Monitoring Officer should accept these. I have requested the Monitoring Officer, Mrs. Lisa Hastings to publish these on Tendring District Council's website and this is why we have a link to this on our Website. This is normal practice so I would send your request to Mrs. Hastings. She has not given us any details of the pecuniary interests that she has received and so we are unable to put these on our Website. It is a duty of the Monitoring Officer to publish these so you will need to apply to her with your request.

I am writing to request an internal review of Frinton and Walton Town Council's handling of my FOI request 'DPI's'.

As you will be aware the Freedom of Information Act has particular ways in which a request can be refused or indeed complied with partially or completely. The guidance of the ICO has not been followed in this case so it is not clear whether you are refusing the request or not, or whether a qualified or a full exemption is being relied upon.

I repeat the relevant part of my request for clarity:

I require to see the registers of disclosable pecuniary interests of all members of the town council. Please furnish this in an accessible electronic form.

Dear Sir,

We would willingly comply with your request if we had the information requested.

As I said in my previous reply we are waiting for the Monitoring Office of Tendring District Council to publish this information on Tendring District Council's website because our Code of Conduct for Members asks Councillors to send their pecuniary interests to her. This is the normal practice.

You need to contact Tendring District Council to find out why this information has not been published. I have requested her to do this and we are still pursuing this matter.

The only reason we cannot supply the information requested is that we do not have this as the forms were not returned to us and we are also anxious for the correct procedure to be followed.

I am writing to request an internal review of Frinton and Walton Town Council's handling of my FOI request 'DPI's'.

The response to my internal review request was not carried out in accordance with the rules laid down by the ICO. Specifically the review has not been undertaken by an independent person from the original request and has not responded to the questions asked about exemptions.

I would ask that this is responded to correctly and in full accordance with ICO rules - failing that a reference to the ICO will be submitted.

Dear Sir,

If you can explain to me how I can give you information that I clearly do not have then I will be more than happy to comply.

As previously explained twice, the Monitoring Officer at Tendring District Council, Lisa Hastings, has received the forms as per our Members Code of Conduct which was adopted by this Council earlier this year. As is the normal practice she should have put the details on the District Council Website which so far she has failed to do. This would then be available to everyone via a link from our Website. This is the practice that has been successful if every other District that I worked in.

If you insist on an independent review that conclusion will be the same. We do not have this information anywhere in this office!! I have always complied with all requests for information but on this occasion I do have the information.
