Dear West Mercia Police,

This is a request for information under the Freedom of Information Act.

For the year 2018 and available data for 2019, I would like to be provided with details on donations, gifts, sponsorships and loans that have been received by the police force.

For each donation, gift, sponsorship and loan, please provide the following information:

- The year that the donation, gift, sponsorship and loan was received
- The sum or value (if known) and description of the donation, gift, sponsorship and loan
- If known, what the donation, gift, sponsorship and loan was subsequently used for e.g. a donation passed to teams working with the local community, or a gift subsequently used in a charity raffle

For each donation, gift, sponsorship and loan, please provide further information regarding where the donation, gift, sponsorship and loan came from:

- If it was an individual, please provide the full name and title of the individual who awarded the donation, gift, sponsorship or loan
- If it was a government department or another public authority such as a council that awarded the donation, gift, sponsorship or loan, please provide the name of that government department or public authority
- If it was a company or organisation or group that awarded the donation, gift, sponsorship or loan, please provide the name of that company or organisation or group
- If it was a foundation or charity that awarded the donation, gift, sponsorship or loan, please provide the name of that foundation or charity

I write in connection with your request for West Mercia Police and
Warwickshire Police information which was dated and received on 1st
February 2019.
 
Your request will now be considered in accordance with the Freedom of
Information Act 2000 (the Act).  You will receive a response within the
statutory timescale of 20 working days as defined by the Act, subject to
the information not being exempt or containing a reference to a third
party.  In some circumstances Warwickshire Police and West Mercia Police 
may be unable to achieve this deadline.  If this is likely you will be
informed and given a revised time-scale at the earliest opportunity.
 
There may be a fee payable for the retrieval, collation and provision of
the information you request.  If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you chose not to make payment then your request will remain
unanswered.

West Mercia Police 11154 and Warwickshire Police 11155 REPLY: The forces
have not received any sponsorship or loans.
Please see the attached table for the information on the Gifts &
Hospitality register that is available under FOI. It has been indicated on
the table with an x where information has been removed as this has bee
considered and I am not obliged to supply the information you have
requested.
 
Section 17 of the Freedom of Information Act 2000 requires West Mercia
Police, when refusing to provide such information (because the information
is exempt) to provide you the applicant with a notice which:   (a) states
that fact, (b) specifies the exemption in question and (c) states (if that
would not otherwise be apparent) why the exemption applies.
 
The exemption applicable to the information is:
 
Section 40 (2)  Personal information
This is an absolute exemption
 
Please be advised that any information released as a result of a Freedom
of Information request, in effect, is being released into the public
domain. Therefore, it could subsequently be published or would have to be
made available to any member of the public if it were requested.
 
Any information that relates to an individual, or from which an individual
could be identified, constitutes personal data and to release information
that constitutes personal data into the public domain contravenes the Data
Protection Act 1998. Some of the information that you have requested
relates to personal data of third parties that have made gifts and/or
donations and therefore it is exempt from disclosure, the exemption that
applies to this type of information is Section 40 of the Freedom of
Information Act 2000.
In accordance with the Act, this letter represents a Refusal Notice for
these parts of the request.
Information has also been summarised in some areas to remove other
information that is not relevant to the disclosure, such as incident/crime
reference numbers and references to specific Police operations/activities.
 
Every effort has been made to ensure that the information provided is as
accurate as possible.
