I am emailing to request the following information under the Freedom of Information Act 2000:

1 a) From 01/01/2016 to 01/12/20, how many domestic homicide offences, where a woman was killed by her current or former male partner, have been recorded by your police force?

1 b) In each of these domestic homicide offences, how many victims were flagged with a domestic violence marker associated with:
– their name
– and/or address
– and/or telephone number
– current or former male partner

2 a) From 01/01/2016 to 01/12/20, how many women whose deaths were reported to your police force as sudden and unexplained had a police record of domestic abuse associated with:
– their name
– and/or address
– and/or telephone number
– current or former male partner

2 b) Of those deaths, how many were investigated as possible homicides?

2 c) Of those which were investigated as possible homicides, how many arrests were made of the woman's current or former male partner?

2 d) Of those partners or former partners who were arrested, how many were subsequently charged with her murder?

2 e) How many were charged with her manslaughter?

2 f) How many were charged with a violent offence or coercive control in relation to that victim following her death?

3) From 01/12/2010 to 01/12/20, how many women in your police force area who are flagged on your computer system with a domestic abuse marker are currently missing?

Having completed enquiries within Essex Police in respect of Section
1(1)(a), Essex Police does hold information relating to your request,
however, the obligation of Section 1(1)(b) cannot be met as Essex Police
does not hold all the information requested in a format that allows it to
be retrieved within the time and cost limits of FOI.

 

When responding to a request for information under the terms of the FOIA,
a public authority is not obliged to provide information if the authority
estimates that the cost of the retrieval of the information requested
would be in excess of £450 (equivalent to 18 hours work).  The costs
criteria relates to a request in its entirety, which means that if we
cannot retrieve all of the information requested within the costs limit,
we are not obliged to retrieve any of the information requested.

 

Section 12(1) of the FOIA states that a public authority is not obliged
to:

 

“…comply with a request for information if the authority estimates that
the cost of complying with the request would exceed the appropriate
limit.”

 

The following explanation outlines the difficulty Essex Police has in
answering your request:

 

Essex Police are unable to accurately extract the level of detail in
relation to Q2F & Q3. This request would entail a large data extract of
all offences and manually reviewing each record one by one to establish
the information held. In relation to Q3; we’d be extracting all DA marked
people on Athena and comparing this with our missing persons database by
first name, surname, date of birth which is bespoke analysis and not
retrievable in a readily accessible format. Essex Police systems are
designed primarily for the management of individual cases and not
primarily for the production of statistical information for FOI
responses.To establish if information is held would, therefore, exceed the
time and cost limits under the FOIA and would qualify as the creation of
data as the results cannot be processed by means of purely sorting or
filtering data sources or running a database query tool. There is no
requirement under the act to create data purely to answer FOI requests.

 

Consequently, and to this extent, Essex Police are exempt from the duty to
provide information you have requested under the provisions of Section
12(1) of the FOIA. Therefore, and in accordance with Section 17(1) of the
FOIA, this communication must act as a refusal notice to provide all of
the information that could be interpreted as being captured by this part
of your request.

 

Having said that and in an effort to assist, although excess cost removes
the force’s obligations under the FOIA, Essex Police can advise that if
you refine your request to the following questions stipulated in your
request, we may be able to provide the answer those.

 

1a) - We can look at homicide crimes by victim / suspect relationship

 

1b) - We can look at sudden death investigations recorded on Athena and
the markers recorded against person records. So we can look if the victim
had one at the date the crime was recorded. Anything else would be
manually creating data with a bespoke piece of analysis e.g. seeing if
there had ever been a DA at an address.

 

Below are results from a previously completed FOI request which may be of
interest to you.

 

1.  The number of domestic violence-related homicides recorded by your
force for the six months from March 2020 to August 2020. Please provide a
breakdown of the victims of these homicides by gender and whether they
were adults or children.

Firstly, I am sorry for the delay in responding to you, we are currently
receiving an increased demand together with a drop in resourcing and
unfortunately some aspect of work are experiencing a delay

 

I have reviewed the original request and the response supplied in respect
of this request. The decision reached previously is upheld as the data is
not held and to provide that data would require a large number of records
to be compared. Essex Police has provided assistance as to what is
potentially achievable and we would deal with any refined FOI request

'Of the 134 domestic homicides, 78 victims were killed by a partner or ex-partner (up from 69), 40 were killed by a parent, son or daughter (up from 28) and 16 were killed by another family member (down from 19).

Almost half (46%) of adult female homicide victims were killed in a domestic homicide (84). Of the 84 female victims, 81 were killed by a male suspect (Appendix table 32).'
