I would be grateful if you could supply me with the following information for the following time frame (01/06/2017 - 31/05/2018).
1) Total number of domain name suspension requests made to Nominet by the FCA. Could I ask that this be broken down into two sections
Number of requests made
and
Number of domains involved
For example, some single requests might have requested 100 domain names be suspended. Whilst others may have only requested one name to be suspended. By breaking it down, it would help us gather a better understanding of scale.
2) Number of domain names requests that were successful. If possible could this be broken down into the same categories?
3) If possible, any details you have on reasons for suspension requests - such as unlicensed sites etc.

Thank you for your request under the Freedom of Information Act 2000 (the
Act), full details of which are attached in Annex A.
We apologise for the delay in responding to your request and appreciate
your understanding and patience.
Before considering your request, it may be helpful to note arrangements
were put in place with Nominet in September 2017 whereby the FCA started
sending them details of UK hosted websites that we believed breached the
Financial Services and Markets Act 2000 (“FSMA”) and requested that they
suspend the sites.
Whilst we can confirm that we have made a number of suspension requests to
Nominet, we do not maintain the number of those requests and therefore we
do not have any responsive information in answer to your questions (1) and
(2 as the information is not readily available.
Therefore, we estimate that to comply with your request would exceed the
cost limit provided in the Freedom of Information and Data Protection
(Appropriate Limit and Fees) Regulations 2004, and that therefore Section
12 (Cost of compliance exceeds appropriate limit) of the Act applies. For
a detailed explanation as to why this exemption applies, please refer to
the Annex B.
In regard to point 3, suspension requests are made in cases where we
believe that a person or firm may be or may have been operating in
contravention of sections 19, 20 or 24 of FSMA, by providing regulated
activities without authorisation, making unauthorised financial promotions
or displaying false claims to be FCA authorised.

* Section 12 (Costs of compliance exceeds appropriate limit)
We are not required to comply with a request under the Act if it would be
too expensive to do so, as estimated in accordance with the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004 (the “Regulations”) made by the Ministry of Justice. The Regulations
provide that, for the FCA, the cost limit is £450, i.e. 18 hours at the
rate of £25 per person hour. The Regulations allow us to take into
account, when estimating the cost of complying with a request, time spent
determining whether we hold the information requested, locating and
retrieving it and extracting the information from the relevant
document(s).
As explained above, the information you are seeking in regard to points 1
and 2, are not recorded or held in a readily extractable format.
Therefore, in order to process your request would require us to retrieve
from archive and manually review case files to see whether a suspension
requests had been made, whether it was successful or not. This exercise,
we believe, would take in excess of 18 hours. We currently do not have a
business need to hold this information in the format you have requested.
On that basis, we estimate that the cost of retrieving the information you
have requested would far exceed the £450 limit.
As our policy is not to divert our resources from our regulatory functions
in order to meet requests under the Act in excess of the cost limit, we
will not carry out an exercise to identify the information you have
requested.

Thank you for your reply. I would like to request a review of the decision not to disclose information on costs grounds.
It would seem somewhat strange that no central records are kept about how many domains name suspensions are requested because surely The FCA would need to cross check to ensure that these domain names have actually been successfully suspended. That seems to be rather worrying in itself, but a separate matter.
However, we are where we are. If the FCA maintain that it is too costly to check internal records. Can I suggest that there maybe a cheaper option. The FCA send a polite email to Nominet to enquire if they hold records of how many requests that the FCA have sent them.
I will also recap and narrow down my request to one question.
1) Can the FCA tell me, how many domain name suspension requests were sent to Nominet between September 2017 and May 31st 2018.

It is not clear from your response whether you are asking for an internal
review of our decision, as the title of your email suggests, or whether
you are asking us to consider a redefined request for the following
information:

Therefore, could you please respond confirming which of the two it is.
Please also note that, while the timeframe you refer to in the email below
is three months narrower than the period taken into consideration in your
original request (1 June 2017 to 31 May 2018), it is still likely that to
comply with your redefined request (should you ask us to do so) will still
exceed the mentioned cost limit for the same reasons explained in our
previous response, and therefore Section 12 (Cost of compliance exceeds
appropriate limit) of the Act will still apply.

Separately can I also offer my assistance in this matter by suggesting that if the FCA still feels that the cost of putting together this information is over the allowance that the FOI Act allows. They could substantially cut the cost of this by a single requesting in an email the data from Nominet.

available. Therefore, even with the above refinement, we estimate that to
process your request would exceed the 18 hour time limit for us to comply
with it and as such Section 12 (Cost of compliance exceeds appropriate

In regard to approaching Nominet for the information, we are not obliged
to do so under the Act. This is because it would result in the FCA
creating new information to comply with a Freedom of Information request;

Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of The Financial Conduct Authority's handling of my FOI request 'Domain Name Suspension Request'.
The claim that it would take more than 18 hours to find the answer to a simple question is in our opinion not credible for so many reasons.
For the FCA to suggest that they don't keep records about how many domains they have tried to remove is in itself worrying. How does the FCA know if Nominet actioned this request and sites were removed? How do you handle prosecutions?
Surely the ability to have domains cancelled must sit with a small group of experienced people. Cancelling domain names is a serious issue and litigation could run into millions if done wrong. Maybe the FCA is suggesting that contacting Nominet and asking for sites to be removed can be done by anyone at the FCA and that this is why it would take more than 18 hours to contact them all and collate the data? That's probably even worse.
Your reply to our suggestion about contacting Nominet to help with an answer shows that you have no intention of taking this seriously and instead are actively trying to block this information from being released to the public.
