It’s clarity may assist you:

Animal crime
Wildlife and animal crime can be a complex area to understand.

To find out what wildlife crime is, go here.

Crimes involving animals that aren’t wildlife crimes, include:

livestock worrying
livestock theft
hunting
animal cruelty
dogs being out of control in public places
banned dogs
Livestock worrying

Livestock worrying is a criminal offence and comes under the Dogs (Protection of Livestock) Act 1953.

‘Worrying’ is where a dog attacks or chases livestock causing injury or suffering.

This isn’t just a threat to a farmer or land owner’s livelihood, it’s also a dangerous situation for the animals involved, and could lead to more risk if the animals get onto the road.

A farmer is allowed to kill the dog if it’s worrying their livestock.

Always keep your dog under control around other animals and if you see a dog on the loose worrying animals, call 101.

Livestock theft

Grazing animals can be an easy target especially in remote rural locations.

check on your animal(s) regularly
report any suspicious vehicles
improve security around the area where the animal(s) graze
ear tags, horn brands, freeze marking, hoof branding, tattoos and microchips can all help identify your animal(s) if they’re stolen
in the case of cattle (cattle, bison or buffalo) you will need to report the loss or theft of an animal to the British Cattle Movement Service within seven days
some areas have Farm Watch schemes, which might be worth joining

Remember, a horse passport is a legal requirement. You can find out how to apply for one here.

Report livestock theft to us either online or by calling 101.

Hunting

Fox hunting

Fox hunting is illegal; trail and drag hunting (where the hunt follows an artificial scent laid out in a trail) is legal. Dogs can be used legally as part of a trail or drag hunt.

There are exemptions under the Hunting Act 2004 which allow for wild animals (including foxes) to be ‘humanely’ killed. Dogs can be legally used to ‘flush’ a fox from cover so it can be shot.

It is an offence to:

engage or participate in the pursuit of a wild animal
use or allow a dog or dogs to pursue a wild animal
knowingly allow land to be entered for the purpose of hunting a fox
hunt foxes with dogs

If you think someone has broken the ban on fox hunting then that's a wildlife crime and you need to let us know, either online or by calling 101.

Animal cruelty

Animal cruelty is when someone doesn’t care for or deliberately hurts an animal.

It can include anything from physical violence, to deliberate mental distress or neglect, for example not feeding or cleaning an animal.

If you see, or suspect, that a person may be treating an animal badly, whether this is physical violence, neglect or any other form of cruelty, you should report this to the RSPCA’s 24-hour cruelty line.

You can contact them on 0300 1234 999. The call will cost the same as any call to a UK landline number.

We work with the RSPCA to investigate cases of animal cruelty.

Dogs out of control in public places

It’s an offence to let a dog be dangerously out of control whether that’s in public or private.

A dog is considered to be out of control if it:

injures someone
makes someone worried that it might injure them

A court could also decide that your dog is dangerously out of control if:

it attacks someone’s animal
the owner of an animal thinks they could be injured if they tried to stop your dog attacking their animal

Please note, a farmer is allowed to kill your dog if it’s worrying their livestock.

If you see a dog loose or seemingly out of control, please tell us by calling 101.

Banned dogs

In the UK, it’s against the law to own certain types of dog. These are the:

Pit Bull Terrier
Japanese Tosa
Dogo Argentino
Fila Brasileiro

It’s also against the law to:

sell a banned dog
abandon a banned dog
give away a banned dog
breed from a banned dog

Whether your dog is a banned type depends on what it looks like, rather than its breed or name.

Dear Sir/Madam,

 

In relation to your queries sent to the FOI Unit on 22/03/19 which could
not be addressed by Legal Services, I have made further enquiries and I
have provided a response to each query below.

 

 

1.    Could you please state if your recording system differs from that of
other police forces and, if so, the what your system of filing  complaints
is ?  (the name of it) - 

 

The system of filing such complaints is the System for Tasking and
Operational Resource Management (STORM) which is the Force Command and
Control System, and LCS which is the Crime Recording System. I am unable
to confirm whether or not any other forces use these systems.   

 

2.    Could you explain EXACTLY what work needs to be done... on the
systems ( you say there are two)  -

 

As per the original refusal notice the incident logs which can be found
within STORM identified as P-Animal will need to be individually
researched to establish whether they relate to ‘dog related harassment’. 
A member of staff would have to read through each incident to establish
whether it is relevant to the request or not.  The STORM system cannot
undertake an electronic search on ‘dog related harassment’ to provide a
response, as they are not broken down under that category.  

In order to establish how many crimes recorded under the offence of
Harassment and Stalking relate to ‘dog related harassment’ each of the
crimes recorded will need to be researched (as per the refusal notice). A
member of staff would have to read through each crime to establish whether
it is relevant to the request or not.  The research would have to be
undertaken via the crime recording system.   

 

3.    Ie. What categories of complaints cover incidents related to the
title is this request? -  

 

As per the initial refusal notice the STORM category is P-Animal and the
Crime Recording System categories are Harassment and Stalking.  

 

4.    Presumably they are the same for all police forces. –

 

I am unable to confirm whether the STORM categories are the same for all
police forces however offence classifications are the same for all police
forces however, unlike some forces, Dyfed-Powys Police does not sub
classify offence codes. For example, the four offences of PHA 1997 listed
within your original request’s clarification would all be recorded under
the one heading of harassment by Dyfed-Powys Police.

 

5.    Could you also assure me that this is not possible to computer
search by category.  Examples by sheep worrying, or a human being bitten
by a dog? –

 

The original response provided to you is still applicable and should you
require information in relation to sheep worrying or a human being bitten
by a dog a further time estimate would apply as there are no categories
within the force’s systems to specifically record this information.

 

6.    And, most importantly, confirm that you have not provided stats to
any government department  related to dogs, either agricultural
harassment, or other. –

 

I have been advised by the relevant departments that Dyfed-Powys Police
has not provided any statistics to any government regarding this subject
matter.

Especially as it is an Agricultural police authority.

There must be a vast difference in police systems to account for it the lack of information held by Dyfed Powys.

Dear Dyfed Powys Police,

On the grounds that another police for e supplied the stats within the 21 dats, plus their policy in dog related incidents.

And there is already partial stats information from another police authority online,

I was wondering if other police forces can provide the information, even with all the help that he be given to Dyfed Oowys, why can’t the stats be provided. What makes DP different from other forces?

Is it that Wales and England have different computer file systems?

Or that English FOIA responders are more diligent?

Dear FOI,

There was no response to my original FOIA.

It went straight into Review ....because of your lack of reply.

I then gave you help and advice received from another police authority.

I then asked you about your system as a subsequent aid to determining how you might be able to find the stats - as other police force readily come up with the stats.

I have already complained to the Information Commissioner’s Office on another Welsh police authority asked to provide the same stats, as it refused..... but I subsequently found it had some stats on its own FOIA website.

To save the Information Commissioner’s Office’s time, energy and public expense, I will return to this correspondence when the decision is made.

I would hope that if the ICO decision is that this authority was wrongful in its response that your authority would consider that would be enough to supply the stats.

Dear FOI,

 

There was no response to my original  FOIA.

 

It went straight into Review ....because of your lack of reply.

 

I then gave you help and advice received from another police authority.

 

I then asked you about your system as a subsequent aid to determining how
you might be able to find the stats -  as other police force readily come
up with the stats.

 

I have already complained to the Information Commissioner’s Office on
another Welsh   police authority asked to provide the same stats, as it
refused..... but I subsequently found it  had some stats on its own FOIA
website.

 

To save the Information Commissioner’s Office’s time, energy and
public expense, I will return to this correspondence when the decision is
made.

 

I would hope that if the ICO decision is that this authority was wrongful
in its response that your authority would consider that would be enough to
supply the stats.
