Dog fouling

We're waiting for Mark Leith to read recent responses and update the status.

Dear Community Safety Glasgow,

I would like to know the following:

1) In relation to The Dog Fouling (Scotland) Act 2003, section 4 - how many persons employed by CSG are currently authorised to issue fixed penalty notices in your area in relation to dog fouling?

2) In relation to The Dog Fouling (Scotland) Act 2003, section 5 - how many fixed penalty notices have been issued by your authorised officers for offences as detailed in The Dog Fouling (Scotland) Act 2003, section 1 in the following years, 2010, 2011, 2012, 2013, 2014 & 2015?

Information by calander year if possible.

I refer to your email, received by Community Safety Glasgow on 17^th March
2016, in which you have made the following request for information:

 

1.      In relation to The Dog Fouling (Scotland) Act 2003, section 4 -
how many persons employed by CSG are currently authorised  to issue fixed
penalty notices in your area in relation to dog fouling?

 

2.      In relation to The Dog Fouling (Scotland) Act 2003, section 5 -
how many fixed penalty notices have been issued by your authorised
officers for offences as detailed in The Dog Fouling (Scotland) Act 2003,
section 1 in the following years, 2010, 2011, 2012, 2013, 2014 & 2015?

I can confirm that CSG holds the information that you are requesting. 

 

CSG considers that the requested information falls under the ambit of the
Environmental Information (Scotland) Regulations 2004 (the “EIRs”) and is
therefore exempt from the scope of a request under the Freedom of
Information (Scotland) Act 2002 (“the 2002 Act”) because of the exemption
contained in section 39(2) thereof.  This provides that information may be
treated as exempt from the scope a request under the 2002 Act where the
information comprises “environmental information”, as defined in the EIRs,
and disclosure of such information is accordingly more appropriately
considered under the specific regulatory regime provided for such
information which is set out in the EIRs.  Further, CSG is of the opinion
that the public interest in considering your request for environmental
information in accordance with the terms of the EIRs outweighs the public
interest in disclosure of such information under the terms of the 2002
Act.

 

“Environmental information” is defined in Regulation 2(1) of the
Regulations and includes measures (including administrative measures),
such as policies, legislation, plans, programmes, environmental
agreements, and activities affecting or likely to affect the elements of
the environment  (such as air and atmosphere, water, soil, land,
landscape) and factors of the environment (such as substances, energy,
noise, radiation of waste, including radioactive waste, emissions,
discharges and other releases into the environment). For further

Prior to releasing the information, Regulation 8 of the Regulations allows
CSG to charge a fee.  This fee is detailed below.  Once the fee is
received we will comply with your enquiry within 20 working days or less,
except to the extent that any material is exempt.  If we do not receive
payment within 60 working days your request will be treated as withdrawn.

 

The fee has been calculated as follows:

 

One Grade 6 officer with an hourly cost to the employer (CSG) of £20.28,
spending 2 hours to reconfigure data on Fixed Penalty Notices issued for
dog fouling currently arranged by financial year into calendar year as
requested.

 

The fee has been calculated as: £40.56

Payment can be made by bank transfer using the following details:

·        Clydesdale Bank

·        Sort Code 82-46-06

·        Account No. 00199522

·        Quoting reference: EIR  94-15

Alternatively, you can pay by cheque or postal order made payable to
‘Community Safety Glasgow’ and posted to Eastgate, 727 London Road,
Glasgow G40 3AQ.

CSG can, however, offer the information you have requested in Q2 for each
FINANCIAL year from 2010/11 to 2014/15 without applying any charge. If you
wish to receive this information structured by financial year instead,
please advise us by return of email. Once we have your confirmation, you
will receive this information within 20 working days or less, except to
the extent that any material is exempt.
