I am making a Freedom Of Information request in respect of the following information.

• Number of applications for a new licence in last 12 months
• Number of applications for a licence renewals in last 12 months
• Number of new licences granted as a result of an application made in the last 12 months
• Number of licences renewed as a result of an application made in the last 12 months
• If appropriate, grounds on which any licence (new or renewal) was refused.
• A copy of each dog breeding licence currently issued.
• Please confirm the number of staff and qualifications of staff employed by each licence holder (for the avoidance of doubt I am not requesting any details of individual staff, just number employed by each licence holder and the qualification(s) held)
• When applying for a new licence or a renewal which of the following do you require in respect of the animals specified in the licence
o Name
o Gender
o Age and/or date of birth
o Microchip number
o Breed
o Description
o Date of purchase
• Where a breeder buys/sells a breeding dog during the period of an issued licence do you require them to notify you of the change at the time of the sale/purchase of the dog or are records only updated at the time of the renewal application?
• What steps, if any, do you take to ensure that each breeder complies with The Microchipping of Dogs (England) 2015 regulations?
• Number of staff employed to conduct inspections during last 12 months

Thank you for your request for information which we are dealing with under
the terms of the Freedom of Information Act 2000.

 

We can confirm that Babergh District Council is the public body
responsible for granting dog breeding licences to businesses in their area
and therefore holds the information requested.

 

The Council is of the view that release of the information requested that
could identify the locations of these businesses either alone or in
conjunction with other information in the public domain, would be likely
to assist individuals involved in the high volume of Puppy theft currently
taking place during the Covid 19 pandemic.

 

Because information released under Freedom of Information responses
becomes available to any requester regardless of motive, the Council has
decided to exempt all requests for copies of and information about Dog
Breeders Licences from release at this time.

 

Public Interest Test

Section 31 (1) (a) is a qualified exemption, and therefore is subject to
the Public Interest Test. Information can only be withheld if the public
interest in maintaining the exemption outweighs the public interest in
disclosure. In assessing where the balance of the public interest lies in
this instance, the Council has considered the following arguments for and
against disclosure.

 

Arguments in favour of disclosure.

There is public interest in the Council being accountable for the
effectiveness of its delivery, licensing and inspections of dog breeding
businesses and premises to the general public.

It is in the interests of open local government and democracy for the
Council to be transparent in its operations and ensure high public
confidence in Local government

 

Arguments against disclosure

There is strong public interest in preventing unlawful theft of puppies
from licenced, lawful and legitimate dog breeding businesses within
Babergh District.

There is strong public interest in protecting the local economy through
ensuring that lawful and legitimate businesses are able to carry out their
business from day to day without introducing undue risks.

There is strong public interest in ensuring puppies are not stolen as they
could suffer cruelty and ill treatment.

 

Conclusion

The Council considers that the public interest in maintaining the
exemption outweighs the public interest in disclosure. The information
which you have requested is therefore withheld under Section and 31 (1)
(a) of the Freedom of Information Act 2000.

The information supplied to you continues to be protected by the
Copyright, Designs and Patents Act 1988. You are free to use it for your
own purposes, including any non-commercial research you are doing and for
the purposes of news reporting. Please contact us if you wish to re-use

Dear Babergh District Council,

I am writing to request an internal review of the handling of my FOI request 'Dog Breeding Licences'.

The copy dog breeding licences provided have been redacted to such an extent that it is not possible to identify the licence holder.

S40 of the Act does not prohibit the provision of personal data. S40 calls for a balance to be struck between data protection principles and the need for transparency.

I believe that the request is lawful, fair and transparent. There would be no point in having a licensing regime in place if nobody can identify who the licence holders are.

The purpose of the request is to identify licence holders, the number of breeding dogs kept by each licence holder, the star rating of each licence holder and any special conditions that attach to each licence. I believe there is a legitimate interest in collecting this data.

In the event that the licence holder trades from a residential address I agree that it would be appropriate to redact the address on the licence. I also agree that it is appropriate to redact the signature and the name of any council employee identified on the licence.
